Mr. Speaker, HR 4600 also punishes victims of government mandates by limiting the ability of those who have suffered adverse reactions from vaccines to collect damages. Many of those affected by these provisions are children forced by federal mandates to receive vaccines. Oftentimes, parents reluctantly submit to these mandates in order to ensure their children can attend public school. HR 4600 rubs salt in the wounds of those parents whose children may have been harmed by government policies forcing children to receive unsafe vaccines.

In conclusion, Mr. Speaker, while I support the efforts of the sponsors of HR 4600 to address the crisis in health care caused by excessive malpractice litigation and insurance premiums, I cannot support this bill. HR 4600 exceeds Congress’ constitutional limitations and denies full compensation to those harmed by the unintentional effects of federal vaccine mandates. Instead of furthering unconstitutional authority, my colleagues should focus on addressing the root causes of the malpractice crisis by supporting efforts to restore the primacy of contract to the doctor-patient relationships.

HR 5710 grants major new powers to the Department of Health and Human Services (HHS) by granting HHS the authority to "administer" the smallpox vaccine to members of the public if the Department unilaterally determines that there is a public health threat posed by smallpox. HHS would not even have to demonstrate an actual threat of a smallpox attack, merely the "potential" of an attack. Thus, this bill grants federal agents the authority to force millions of Americans to be injected with a potentially lethal vaccine based on nothing more than a theoretical potential smallpox incident. Furthermore, this provision continues to restrict access to the smallpox vaccine from those who have made a voluntary choice to accept the risk of the vaccine in order to protect themselves from smallpox. It is hard to think of a more blatant violation of liberty than allowing government officials to force people to receive potentially dangerous vaccines based on hypothetical risks.

For example, this bill provides a hidden subsidy to vaccine manufacturers by transferring liability for injuries caused by the smallpox vaccine from the companies to the United States Taxpayer. It also provides $3.2 billion dollars for yet another government bailout of the airline industry, as well as a hidden subsidy to the airlines in the form of $235 million of taxpayer money to pay for costs associated with enhanced baggage screening. Mr. Speaker, there is no more constitutional reason for the taxpayer to protect what is, after all, the airlines’ private property, than there is for the taxpayer to subsidize security costs at shopping malls or factories. Furthermore, the airlines could do a more efficient and effective job at providing security if they were freed from government rules and regulations. I remind my colleagues that it was government bureaucrats who disarmed airline pilots, thus leaving the pilots of the planes used in the September 11 attacks defenseless against the terrorists. I would also remind my colleagues that anti-gun fanatics in the federal bureaucracy continue to prevent pilots from carrying firearms.

Mr. PAUL. Mr. Speaker, Supreme Court Justice Louis Brandeis famously said, “Sunlight is the best disinfectant.” In order to shine sunlight on the practices of the House of Representatives, and thus restore public trust and integrity to this institution, I am introducing the sunlight rule, which amends House rules to ensure that Members have adequate time to study a bill before being asked to vote on it. One of the chief causes of increasing public cynicism regarding Congress is the way major pieces of legislation are brought to the floor without Members having an opportunity to read the bills. This is particularly a problem with the Appropriations conference reports, which are often rushed to the floor of the House in late-night sessions at the end of the year. For example, just this past December, the House voted on the Fiscal Year 2006 Defense Appropriations Conference Report at approximately 4 a.m. — just 4 hours after the report was filed. Yet, the report contained language dealing with avian flu, including controversial language regarding immunity liability for vaccine manufacturers, that was added in the House-Senate conference on the bill. Considering legislation on important issues in this manner is a dereliction of our duty as the people’s elected representatives.

As a medical doctor, I believe mandated smallpox vaccines are bad medicine. The available vaccine poses significant risks, even though the more serious complications affect only a statistically small number of people. As with any medical treatment, these risks must always be balanced against the perceived benefit. Remember, not a single case of smallpox has been reported, despite the near-hysteria that characterized recent news reports. Even if some individuals became infected, smallpox spreads only with very close contact. Those in the surrounding community could then decide to accept vaccines based on a much more tangible risk.

As a legislator, I believe mandated smallpox vaccines are very bad policy. The point is not that smallpox vaccines are necessarily a bad idea, but rather that intimately personal medical decisions should not be made by government. The real issue is individual medical choice. No single person, including the President of the United States, should ever be given the power to make a medical decision for potentially millions of Americans. Freedom over one’s physical person is the most basic freedom of all, and people in a free society should be sovereign over their own bodies. When we give government the power to make medical decisions for us, we in essence accept that the state owns our bodies.

The possibility that the federal government could order vaccines is real. Provisions buried in the 500-page homeland security bill give federal health bureaucrats virtually unchecked power to declare health emergencies. Specifically, it gives the Secretary of the Department of Health and Human Services- in my view one of the worst of all federal agencies- power to declare actual or potential bioterrorist emergencies; to administer forced "countermeasures," including vaccines, to individuals or whole groups; and to extend the emergency declaration indefinitely. These provisions mirror those found in the Model Emergency Health Powers Act, a troubling proposal that was rejected by most state legislatures last year. That Act would have given state governors broad powers to suspend civil liberties and declare health emergencies. Yet now we’re giving virtually the same power to the Secretary of HHS. Equally troubling is the immunity from civil suit granted to vaccine manufacturers in the homeland security bill, which potentially could leave individuals who get sick from a bad batch of vaccines without legal recourse.

Politics and medicine don’t mix. It is simply not the business of government at any level to decide whether you choose to accept a smallpox vaccine or any other medical treatment. Yet decades of federal intervention in health care, including the impact of third-party HMOs created by federal legislation, have weakened the doctor-patient relationship. A free market system would allow doctors and patients to make their own decisions about smallpox inoculations, without the federal government hoarding, mandating, nor prohibiting the vaccine. Instead, we’re moving quickly toward the day when government controls not only what vaccines patients receive, but what kind of health care they receive at all.

Parents must do everything possible to retain responsibility and control over their children’s well-being. There is no end to the bureaucratic appetite to rule every aspect of our lives, including how we raise our children. Forced mental health screening is just the latest of many state usurpations of parental authority: compulsory education laws, politically-correct school curricula, mandatory vaccines, and interference with discipline through phony “social services” agencies all represent assaults on families. The political right has now joined the political left in seeking the de facto nationalization of children, and only informed resistance by parents can stop it. The federal government is slowly but surely destroying real families, but it is hardly a benevolent surrogate parent.
