Curbing free expression, even that which is violent and profane, is un-American and cannot solve our school problem. Likewise, gun laws do not work, and more of them only attack the liberties of law-abiding citizens. Before the first Federal gun law in 1934, there was a lot less gun violence, and guns were readily accessible to everyone. However, let me remind my colleagues, under the Constitution, gun regulations and crime control are supposed to be State issues.

I realize that all conservatives are not neoconservatives, and all neocons don’t necessarily agree on all points—which means that in spite of their tremendous influence, most Members of Congress and those in the administration do not necessarily take their marching orders from the AEI or Richard Perle. But to use this as a reason to ignore what neoconservative leaders believe, write about it and agitate for—with amazing success I might point out—would be at our own peril. This country still allows open discourse—though less everyday—and we who disagree should push the discussion and expose those who drive our policies. It is getting more difficult to get fair and balanced discussion on the issues, because it has become routine for the hegemons to label those who object to preemptive war and domestic surveillance as traitors, unpatriotic and un-American. The uniformity of support for our current foreign policy by major and cable-news networks should concern every American. We should all be thankful for CSPAN and the internet.

We were told we had to support this pre-emptive war against Iraq because Saddam Hussein had weapons of mass destruction (and to confront al Qaeda). It was said our national security depended on it. But all these dangers were found not to exist in Iraq. It was implied that lack of support for this Iraqi invasion was un-American and unpatriotic.

Why We Fight

Many reasons have been given for why we fight and our youth must die in Iraq. The reasons now given for why we must continue this war bear no resemblance to the reasons given to gain the support of the American people and the United States Congress prior to our invasion in March of 2003. Before the war, we were told we faced an imminent threat to our national security from Saddam Hussein. This rationale, now proven grossly mistaken, has been changed. Now we’re told we must honor the fallen by “completing the mission.” To do otherwise would demean the sacrifice of those who have died or been wounded. Any lack of support for “completing the mission” is said, by the promoters of the war, to be unpatriotic, un-American, and detrimental to the troops. They insist the only way one can support the troops is to never waver on the policy of nation building, no matter how ill-founded that policy may be. The obvious flaw in this argument is that the mission, of which they so reverently speak, has changed constantly from the very beginning.

It’s not unusual for the war crusaders to condemn those who speak the truth in an effort to end an unnecessary war. They claim those who want honest reasons for the enormous sacrifice are unpatriotic and un-American, but these charges only serve to exacerbate the social unrest. Any criticism of policy, no matter how flawed the policy is, is said to be motivated by a lack of support for the troops. Yet it is preposterous to suggest that a policy that would have spared the lives of 1900 servicemen and women lacks concern for the well being of our troops. The absence of good reasoning to pursue this war prompts the supporters of the war to demonize the skeptics and critics. They have no other defense.

But I am asking you to reconsider the fact that moving in this direction is the same thing as we did against Iraq, and it won’t do us any good. It is going to cost us a lot of money, and it is going to cost a lot of lives, and it is un-American. It is not constitutional. It is not moral. We should not pursue this type of foreign policy. We should take care of ourselves, and we should be more friendly with nations. We should be willing to trade. And if you are concerned about the world, why not set a good example? When our house is clean, when we have a good democracy and a worthy Republic, and we do well, believe me, they will want to emulate us.

The anger over the Iraq war is multifaceted. Some are angry believing they were lied to in order to gain their support at the beginning. Others are angry that the forty billion dollars we spend every year on intelligence gathering failed to provide good information. Proponents of the war too often are unable to admit the truth. They become frustrated with the progress of the war and then turn on those wanting to change course, angrily denouncing them as unpatriotic and un-American.

Both sides of the war in the Middle East are driven by religious beliefs of omnipotence. Both sides endorse an eschatological theory regarding the forthcoming end of time. Both anticipate the return of God personified and as promised to each. Both sides are driven by a conviction of perfect knowledge regarding the Creator, and though we supposedly worship the same God, each sees the other side as completely wrong and blasphemous. The religiously driven Middle East war condemns tolerance of the other’s view. Advocates of restraint and the use of diplomacy are ridiculed as appeasers and equivalent to supporting Nazism and considered un-American and un- Christian.

Much of the legislation referenced in this legislation is legislation that I supported. For example, I voted in favor of the Border Protection, Anti-terrorism, and Illegal Immigration Control Act of 2005 and for the SAFE Port Act of 2006. I continue to support measures that help secure our borders and thereby make us less vulnerable to future foreign attack. However, I find it particularly unacceptable to heap praise on the PATRIOT Act, as this bill does. This act expanded the federal government’s power to an unprecedented degree at the expense not of foreign terrorists, but of law-abiding American citizens. It opened average Americans up to wide-ranging government snooping and surveillance in matters completely unrelated to terrorism. For example, the “sneak and peek” provisions of the PATRIOT Act allow law enforcement to enter someone’s home without a warrant, search that property, and never inform that citizen they had been there. Also, libraries and book stores can be forced to provide the government with citizens’ borrowing and purchasing history without showing probable cause. I see no reason to applaud such an un-American piece of legislation.

During a time when an increasing number of senior citizens are able to enjoy productive lives well past retirement age and businesses are in desperate need of experienced workers, it makes no sense to punish seniors for working. Yet the federal government does just that through Social Security "earnings limitations." Earnings limitations deduct a portion of seniors' monthly Social Security check should they continue to work and earn income above an arbitrary government-set limit. By providing a disincentive for seniors to remain in the workplace, this restriction damages the economy and punishes individuals for seeking gainful employment. It is simply un-American that the federal government would punish someone for continuing to contribute to the economy by reducing benefits that person has already paid for and been promised by Congress.

In a word, the death tax is simply un-American. People should not be punished for working hard their entire lives, creating jobs and wealth for others, and then trying to leave some of it so their children can have better lives. I applaud the members of the House who had the courage to cast the historic vote today to repeal the death tax. Now, I call on the members of the Senate and the President to support this legislation. The time has come to create a government that is supportive, not oppressive to the small business owner and the family farmer. If we put our faith in the American people, instead of the government, we will increase individual savings, promote job creation and, most importantly, support the family structure.

Second, freedom of the press applies equally to all Americans, not just the institutional, government-approved media. An unknown internet blogger, a political party, a candidate, and the New York Times should all enjoy the same right to political speech. Yet McCain-Feingold treats the mainstream press as some kind of sacred institution rather than the for-profit industry it is. Why should giant media companies be able to spend unlimited amounts of money to promote candidates and issues, while an organization you support cannot? The notion of creating a preferred class of media, with special First Amendment rights, is distinctly elitist and un-American.

In communist East Germany , one in every 100 citizens was an informer for the dreaded secret police, the Stasi. They either volunteered or were compelled by their government to spy on their customers, their neighbors, their families, and their friends. When we think of the evil of totalitarianism, such networks of state spies are usually what comes to mind. Yet, with modern technology, what once took tens of thousands of informants can now be achieved by a few companies being coerced by the government to allow it to listen in to our communications. This surveillance is un-American.

I have introduced legislation many times to abolish the IRS and the income tax. It is fundamentally un-American to require taxpayers to testify against themselves and be considered guilty until proven innocent. Abolishing the IRS altogether would trigger an avalanche of real growth in the economy.
