And it is all done in the name of promoting the United Nations and one-world government.

Voluntary contracts. There is little understanding or desire in Congress to consistently protect voluntary contract. Many of our programs to improve race relations have come from government interference in the voluntary economic contract. Government’s role in a free society should be to enforce contracts, yet too often it does the opposite. All labor laws, affirmative action programs and consumer protection laws are based on the unconstitutional authority of government to regulate voluntary economic contracts. If the same process were applied to the press, it would be correctly condemned as prior restraint and ruled unconstitutional.

And then there are groups who would defend property rights, and there will be groups who will come who will be lobbyist types and influential groups, and they want to influence elections, and they may be adamantly opposed to the United Nations and interference in foreign policies overseas. They have a legitimate right to come here.

Mr. PAUL. Mr. Speaker, I rise today to express skepticism regarding H.R. 4105, The Internet Tax Freedom Act. The stated goal of H.R. 4105 certainly is noble: “A bill to establish a national policy against State and local interference with interstate commerce on the Internet, to exercise congressional jurisdiction over interstate commerce by establishing a moratorium on the imposition of exactions that would interfere with the free flow of commerce via the Internet, to establish a national policy against federal and state regulation of Internet access and online services, and for other purposes.” The bill’s name, “Tax Freedom,” also expresses a laudable notion. One must always be wary of misnomers in Washington — the Justice Department comes to mind as one quick example. The late economic historian, Murray N. Rothbard, Ph.D., so warned when he stated “when someone in government mentions the word ‘fairness’, grab your wallet and run for the hills.”

Most importantly, MSA’s are the best means available to preserve the patient’s right to choose their doctor and the treatment that best meets their needs, free from interference by an insurance company or an HMO.

Despite DSHEA, officials of the Food and Drug Administration (FDA) continued to attempt to enforce regulations aimed at keeping the American public in the dark about the benefits of dietary supplements. However, in the case of Pearson v. Shalala, 154 F.3d 650 (DC Cir. 1999), reh’g denied en banc, 172 F.3d 72 (DC Cir. 1999) , the United States Court of Appeals for the DC Circuit Court reaffirmed consumers’ first amendment right to learn about how using dietary supplements can improve their health without unnecessary interference from the FDA. The FDA has been forced to revise its regulations in order to comply with Pearson. However, members of Congress have had to intervene with the FDA on several occasions to ensure that they followed the court’s order. Clearly Congress must continue to monitor the FDA’s action in this area.

H.R. 1 increases federal control over education through increases in education spending. Because “he who pays the piper calls the tune,” it is inevitable that increased federal expenditures on education will increase federal control. However, Mr. Chairman, as much as I object to the new federal expenditures in H.R. 1, my biggest concern is with the new mandate that states test children and compare the test with a national normed test such as the National Assessment of Education Progress (NAEP). While proponents of this approach claim that the bill respects state autonomy as states’ can draw up their own tests, these claims fail under close observation. First of all, the very act of imposing a testing mandate on states is a violation of states’ and local communities’ authority, protected by the 10th Amendment to the United States Constitution, to control education free from federal interference.

I am also concerned about the emerging nation-building component of our activities in Afghanistan. If, as it appears, our military action in Afghanistan is to benefit the Northern Alliance opposition group, what assurances do we have that this group will not be every bit as unpopular as the Taliban, as press reporting suggests? Not long ago, it was the Taliban itself that was the recipient of U.S. military and financial support. Who is to say that Afghanistan might not benefit from a government managed by several tribal factions with a weak central government and little outside interference either by the U. S. or the UN? Some have suggested that a western-financed pipeline through Afghanistan can only take place with a strong and “stable” government in place- and that it is up to the U.S. government to ensure the success of what is in fact a private financial venture. Whatever the case, my colleagues in Congress and those in the administration openly talk of a years-long post-war UN presence in Afghanistan to “build institutions.”

Proponents of this legislation claim to support free trade, but really they support government-managed trade that serves certain interests at the expense of others. True free trade occurs only in the absence of interference by government, that’s why it’s called “free”- it’s free of government taxes, quotas, or embargoes. The term ”free-trade agreement“ is an oxymoron. We don’t need government agreements to have free trade; but we do need to get the federal government out of the way and unleash the tremendous energy of the American economy.

Mr. Speaker, I am disheartened by the administration’s recent decision to impose a 30 percent tariff on steel imports. This measure will hurt far more Americans than it will help, and it takes a step backwards toward the protectionist thinking that dominated Washington in decades past. Make no mistake about it, these tariffs represent naked protectionism at its worst, a blatant disregard of any remaining free-market principles to gain the short-term favor of certain special interests. These steel tariffs also make it quite clear that the rhetoric about free trade in Washington is abandoned and replaced with talk of “fair trade” when special interests make demands. What most Washington politicians really believe in is government-managed trade, not free trade. Mr. Speaker, it’s always amazing to me that Washington gives so much lip service to free trade while never adhering to true free trade principles. Free trade really means freedom- the freedom to buy and sell goods and services free from government interference. Time and time again, history proves that tariffs don’t work. Even some modern Keynesian economists have grudgingly begun to admit that free markets allocate resources better than centralized planning. Yet we cling to the idea that government needs to manage trade, when it really needs to get out of the way and let the marketplace determine the cost of goods. I sincerely hope that the administration’s position on steel does not signal a willingness to resort to protectionism whenever special interests make demands in the future.

Balance of power in this area of the world has always been delicate, and outside interference serves only to destabilize. There’s no evidence that our current efforts will lead to more stability. Promoting democracy, as it’s said we’re doing, is a farce. If elections were to occur in most of the Arab countries today, Osama bin Laden and his key allies would win. Besides, it seems we adapt quite well to working with military dictators that have ousted elected leaders, as we do in Pakistan by rewarding their cooperation with huge subsidies and future promises.

I would remind my colleagues that the WTO has oftentimes ruled against the United States and Congress is right now changing United States tax laws to please the WTO. Ceding control over United States tax and trade policy to this international organization violates the United States Constitution and is contrary to the interests of American citizens. Therefore, it is not wise to endorse the WTO process by encouraging other countries to submit to WTO control.

A strong case can be made that all the conflicts, starting with the Spanish-American War up to our current conflict in the Middle East, could have been avoided. For instance, the foolish entrance into World War I to satisfy Wilson’s ego led to a disastrous peace at Versailles, practically guaranteeing World War II. Likewise, our ill-advised role in the Persian Gulf War I placed us in an ongoing guerilla war in Iraq and Afghanistan, which may become a worldwide conflict before it ends. Our foolish antics over the years have prompted our support for many thugs throughout the 20th Century — Stalin, Samoza, Batista, the Shah of Iran, Noriega, Osama bin Laden, Saddam Hussein, and many others — only to regret it once the unintended consequences became known. Many of those we supported turned on us, or our interference generated a much worse replacement — such as the Ayatollah in Iran. If we had consistently followed the wise advice of our early presidents, we could have avoided the foreign policy problems we face today. And if we had, we literally would have prevented hundreds of thousands of needless deaths over the last century. The odds are slim to none that our current failure in Afghanistan and Iraq will prompt our administration to change its policies of intervention. Ignoring the facts and rigidly sticking to a failed policy — a foolish consistency — as our leaders have repeatedly done over the past 100 years, unfortunately will prevail despite its failure and huge costs. This hostility toward principled consistency and common sense allows for gross errors in policy making. Most Americans believed, and still do, that we went to war against Saddam Hussein because he threatened us with weapons of mass destruction and his regime was connected to al Qaeda. The fact that Saddam Hussein not only did not have weapons of mass destruction, but essentially had no military force at all, seems to be of little concern to those who took us to war. It was argued, after our allies refused to join in our efforts, that a unilateral approach without the United Nations was proper under our notion of national sovereignty. Yet resolutions giving the President authority to go to war cited the United Nations 21 times, forgetting the U.S. Constitution allows only Congress to declare war. A correct declaration of war was rejected out of hand. Now with events going badly, the administration is practically begging the UN to take over the transition — except, of course, for the Iraqi Development Fund that controls the oil and all the seized financial assets. The contradictions and distortions surrounding the Iraqi conflict are too numerous to count. Those who wanted to institutionalize the doctrine of pre-emptive war were not concerned about the Constitution or consistency in our foreign policy. And for this, the American people and world peace will suffer.

The Court determined that Texas has no right to establish its own standards for private sexual conduct, because these laws violated the court’s interpretation of the 14th Amendment. Regardless of the advisability of such laws, the Constitution does not give the federal government authority to overturn these laws. Under the Tenth Amendment, the state of Texas has the authority to pass laws concerning social matters, using its own local standards, without federal interference. But rather than adhering to the Constitution and declining jurisdiction over a state matter, the Court decided to stretch the “right to privacy” to justify imposing the justices’ vision on the people of Texas.

Because of the Federal Government’s poor record in protecting privacy, I do not believe the best way to address concerns about the misuse of genetic information is through intrusive Federal legislation. Uniform Federal mandates are a clumsy and ineffective way to deal with problems such as employers making hiring decisions on the basis of a potential employee’s genetic profile. Imposing Federal mandates on private businesses merely raises the costs of doing business and thus reduces the employment opportunities for all citizens. A much better way to eliminate irrational discrimination is to rely on state and local regulation. Unlike the Federal Government, states and localities are able to tailor their regulations to fit the needs of their particular populaces. I would remind my colleagues that 34 states currently ban genetic discrimination in employment, while 46 states forbid health insurers from engaging in genetic discrimination. Clearly, the states are capable of addressing this issue without interference from Washington. My colleagues should also remember that Congress has no constitutional authority to forbid private sector employers from making hiring or other employment decisions on the basis of genetic information.

For example, I would support the disaster relief package if the package were offset by reductions in other spending, particularly reductions in our overseas commitments. Unfortunately, H.R. 2638 not only fails to reduce spending to finance disaster aid; it attaches money for the country of Georgia onto the disaster aid package. Georgia is not receiving this money because it was affected by a natural disaster but because it was involved in a military conflict with Russia —which was started by Georgia! It is an insult to the American people to divert money that could have gone to help the victims of Hurricane Ike to promote interference in a conflict that in no way threatens the security of the American people.

Any list of individual rights must also include the right to enter into voluntary exchanges with others. Removing trade barriers benefit consumers who can purchase goods more cheaply than previously available from those who have a comparative advantage in the respective good. Those individuals who choose, for moral or religious reasons, not to trade with citizens of particular foreign jurisdictions are, of course, not threatened by removing barriers for those who, for whatever reasons, choose to do so. Further, the right of United States citizens to travel freely, at their own expense, is also infringed upon by the portion of the bills limiting the availability of commercial flights.

Free trade is not a zero-sum game where some countries benefit and others inevitably suffer. On the contrary, true free trade by definition benefits both parties. Free trade is the process of free people engaging in market activity without government interference such as tariffs or managed-trade agreements. In a true free market, individuals and companies do business voluntarily, which means they believe they will be better off as a result of a transaction. Tariffs, taxes, and duties upset the balance, because governments add costs to the calculation which make doing business less attractive. Similarly, so-called managed trade agreements like WTO favor certain business interests and trading nations over others, which reduces the mutual benefit inherent in true free trade.

The IBT tragedy is about religious liberty, not taxes. Churches should not be required to pay or withhold taxes any more than they should be given tax dollars from the government. The First amendment grants churches the absolute right to freely exercise their religious beliefs without interference from government. When tax laws force churches to act as collection agents for the IRS, this precious right is lost. The income tax represents the ultimate entanglement between churches and the government. When churches file income tax returns, the government becomes intimately familiar with their activities. Only those faiths deemed valid by IRS bureaucrats are rewarded with partial tax-exempt status. This entanglement chills true religious expression, because churches may alter their message to quell criticisms of government and avoid audits. When the government has the power to tax churches, it ultimately has the power to control them.

Specifically, the bill changes the tax code to clarify that no church or religious organization will lose its tax-exempt status because it participates in political campaigns or works to influence legislation. This bill is badly needed to end the IRS practice of threatening certain politically disfavored faiths with loss of their tax-exempt status, while ignoring the very open and public political activities of other churches. While some well-known leftist preachers routinely advocate socialism from the pulpit, many conservative Christian and Jewish congregations cannot present their political beliefs without risking scrutiny from the tax collector. The "Houses of Worship Political Speech Protection Act" (HR 2357) will end this political favoritism and government interference with free speech. I'm pleased to report that the Act already has been sponsored by more that 50 members of Congress.

The judges who made this unfortunate ruling simply do not understand the First amendment. It does not bar religious expression in public settings or anywhere else. In fact, it expressly prohibits federal interference in the free expression of religion. Far from mandating strict secularism in schools, it instead bars the federal government from prohibiting the pledge of allegiance, school prayer, or any other religious expression. So why is there not more outrage about government financial accountability? Of course we read the occasional news article lamenting $400 hammers at the Pentagon, but for the most part Congress gets a free pass on its own fiscal mismanagement. As economist Thomas DiLorenzo points out, the fundamental problem is government interference with supply in the electricity market. The nation’s population has risen dramatically in the last 30 years, causing a huge increase in demand for electricity. Pharmaceutical companies spend hundreds of millions of dollars to bring a single drug to market because of FDA rules. Often FDA approval is never obtained, no matter how much a company spends developing a drug. So pharmaceutical makers naturally try to recoup their huge investments by charging high prices and lobbying to keep exclusive drug patent periods as lengthy as possible. We need to understand that the FDA does far more harm than good, both in terms of drug prices and the incalculable chilling effect it has on needed drug research. With less FDA interference, patents could be shortened and drug development costs reduced. This would allow greater price competition between drug companies.

The idea is not new, as politicians have talked about using government to advance marriage for decades. But federal promotion of marriage, even if well-intentioned, is a form of social engineering that should worry anyone concerned with preserving a free society. This is not to say that the Founders intended or imagined a libertine America. Parents must do everything possible to retain responsibility and control over their children’s well-being. There is no end to the bureaucratic appetite to rule every aspect of our lives, including how we raise our children. Forced mental health screening is just the latest of many state usurpations of parental authority: compulsory education laws, politically-correct school curricula, mandatory vaccines, and interference with discipline through phony “social services” agencies all represent assaults on families. The political right has now joined the political left in seeking the de facto nationalization of children, and only informed resistance by parents can stop it. The federal government is slowly but surely destroying real families, but it is hardly a benevolent surrogate parent.

The administration speaks of private accounts, but government-managed investment of Social Security funds is not privatization at all. True capitalism by definition operates without government interference, and we should oppose further government involvement in the financial markets. After all, which government officials will decide what stocks, bonds, mutual funds, or other investment vehicles are approved? Which politicians will you trust to decide what your portfolio may contain? Imagine the lobbyists fighting over which special interests will have their favored investments approved for Social Security accounts. Political favoritism, rather than market performance, will determine what investments are allowed, and Social Security in essence will become a huge source of taxpayer-provided investment capital.

A truly democratic election in Iraq, without U.S. interference and U.S. puppet candidates, almost certainly would result in the creation of a Shiite theocracy. Shiite majority rule in Iraq might well mean the complete political, economic, and social subjugation of the minority Kurd and Sunni Arab populations. Such an outcome would be democratic, but would it be free? Would the Kurds and Sunnis consider themselves free? The administration talks about democracy in Iraq, but is it prepared to accept a democratically-elected Iraqi government no matter what its attitude toward the U.S. occupation? Hardly. For all our talk about freedom and democracy, the truth is we have no idea whether Iraqis will be free in the future. They’re certainly not free while a foreign army occupies their country. The real test is not whether Iraq adopts a democratic, pro-western government, but rather whether ordinary Iraqis can lead their personal, religious, social, and business lives without interference from government.

There are also practical reasons to oppose governmental foreign aid. Though it may be given with the best intentions, government agencies simply cannot do the kind of job that private charities do in actually helping people in need. Government-to-government assistance seldom helps those really in need. First, because it comes from governments it usually has political strings attached to it, and as such is really a cover for political interventionism. Take our own National Endowment for Democracy for example. The “aid” money it spends is usually spent trying to manipulate elections overseas so that a favored foreign political party wins “democratic” elections. This does no favor to citizens of foreign countries, who vote in the hope that they may choose their own leaders without outside interference.
