Fiscally conservative members of Congress were even told that the bill would be budget neutral! Yet, when the House of Representatives initially considered creating a Department of Homeland Security, the legislative vehicle almost overnight grew from 32 pages to 282 pages- and the cost had ballooned to at least $3 billion. Now we are prepared to vote on a nearly 500-page bill that increases federal expenditures and raises troubling civil liberties questions. Adding insult to injury, this bill was put together late last night and introduced only this morning. Worst of all, the text of the bill has not been made readily available to most members, meaning this Congress is prepared to create a massive new federal agency without even knowing the details. Not only does this proposal fail to comport with the intention of the founders of this nation, but even worse, it advocates a solution that has been repeatedly rejected by this body. During the Civil War, the neighboring state of Virginia, where today many Capitol Hill staffers and members reside, was actively involved in hostilities against the United States Government, yet Abraham Lincoln never suggested that non-elected persons serve in the House. Forty-two years ago, Americans wrestled with a hostile superpower that had placed nuclear weapons just 90 miles off the Florida coast, yet no one suggested we consider taking away the people’s right to elect their representatives in order to ensure “continuity of government!” House of Representatives The “Continuity of Government” Proposal – A Dangerous and Unnecessary Threat to Representative Rule June 30, 2003 2003 Ron Paul 72:1 The COGC Proposal The “Continuity of Government Commission” (COGC), spearheaded by the Brookings Institution and the American Enterprise Institute, recently issued proposals for the operation of Congress following a catastrophic terrorist attack. Specifically, COGC advocates a constitutional amendment calling for the appointment of individuals to the House of Representatives to fill the seats of dead or incapacitated members, a first in American history. An examination of the proposal reveals that it is both unnecessary and dangerous. House of Representatives The “Continuity of Government” Proposal – A Dangerous and Unnecessary Threat to Representative Rule June 30, 2003 2003 Ron Paul 72:5 The scenarios offered by the commission, while theoretically possible, are highly unlikely to disable Congress. Remember, a majority of members assemble together in one place only rarely; even during votes most members are not on the floor together at the same time Inauguration ceremonies and State of the Union addresses often bring together a majority of members in the same place, but simple precautions could be taken to keep a sufficient number away from such events. Even a direct terrorist attack on the Pentagon failed to disrupt the operation of the Department of Defense. The COGC proposal exaggerates the likelihood that a terrorist strike on Washington would incapacitate the House of Representatives, and exaggeration is a bad reason to amend the Constitution. House of Representatives The “Continuity of Government” Proposal – A Dangerous and Unnecessary Threat to Representative Rule June 30, 2003 2003 Ron Paul 72:6 Existing Constitutional Provisions are Adequate It is important to understand that the Constitution already provides the framework for Congress to function after a catastrophic event. Article I section 2 grants the governors of the various states authority to hold special elections to fill vacancies in the House of Representatives. Article I section 4 gives Congress the authority to designate the time, manner, and place of such special elections if states should fail to act expeditiously following a national emergency. As Hamilton explains in Federalist 59, the “time, place, and manner” clause was specifically designed to address the kind of extraordinary circumstances imagined by COGC. Hamilton characterized authority over federal elections as shared between the states and Congress, with neither being able to control the process entirely. The House must be elected. Even “temporary” appointees would be unacceptable, because the laws passed would be permanent. The House of Representatives represents the people, not the states. Single states often exhibit wide variations in political makeup even among voters of the same party. Appointment by governors, even though the successors represent the dead member’s party choice, could change the ideological composition of Congress contrary to the will of the people. Furthermore, voters choose an individual candidate, not a panel. They should not be required to consider the qualifications of a candidate’s potential successors. House of Representatives The “Continuity of Government” Proposal – A Dangerous and Unnecessary Threat to Representative Rule June 30, 2003 2003 Ron Paul 72:14 COGC focuses on government legitimacy, arguing that a House of Representatives with only a handful of surviving members would not be seen as legitimate by the public. In fact the opposite is true: appointed “representatives” will never be seen as legitimate and in fact would not be legitimate. Without exception, every member of the House of Representatives has been elected by voters in the member’s district. Madison states in Federalist 52 that “The definition of the right of suffrage is very justly regarded as a fundamental article of republican government.” The very legitimacy of the House of Representatives is based on its constitutional status as the most directly accountable federal body. House of Representatives The “Continuity of Government” Proposal – A Dangerous and Unnecessary Threat to Representative Rule June 30, 2003 2003 Ron Paul 72:16 Consider a scenario COGC forgot to mention. Imagine a terrorist strike kills a majority of members of the House of Representatives. 200 members survive, and 235 are appointed by state governors on a “temporary basis.” This new body considers a bill that drastically increases taxes to pay for emergency measures, while suspending civil liberties and imposing martial law. The bill passes, with 195 elected members opposed and all 235 appointed members in favor. Only 5 elected members support the measure. Would the electorate consider this legislation legitimate? This issue has recently attracted attention because of the proposal of the “Continuity of Government (COG) Commission,” that the Constitution be amended to allow appointed persons to fill vacancies in the House in the event of an emergency. House of Representatives Protection Of Lawful Commerce In Arms Act 20 october 2005 2005 Ron Paul 106:7 I am particularly disturbed that the House of Representatives’ leadership has taken the unusual step of bringing S. 397 to the floor for a vote without House members at least having an opportunity to vote on removing the gun control amendments. Instead of voting on a bill that contains the new gun control provisions, we should be considering H.R. 800, the House version of S. 397 prior to its perversion by gun control amendments. Notably, Gun Owners of America has written to House members to request that they oppose S. 397 and, instead, support H.R. 800. Last month, I wrote to House Speaker DENNIS HASTERT, Majority Leader TOM DELAY, and Committee on the Judiciary Chairman JAMES SENSENBRENNER of my opposition to these anti-gun rights provisions in S. 397. While I am concerned about some of the federalism implications of H.R. 800, it is a far superior bill because it neither requires gun locks nor restricts gun owners’ ammunition choices. This bill is being rushed to the floor in order to assure the American people that Congress is “cracking down” on lobbying practices in response to recent scandals. Mr. Speaker, Supreme Court Justice Louis Brandeis famously said, “Sunlight is the best disinfectant.” In order to shine sunlight on the practices of the House of Representatives, and thus restore public trust and integrity to this institution, I am introducing the sunlight rule, which amends House rules to ensure that Members have adequate time to study a bill before being asked to vote on it. One of the chief causes of increasing public cynicism regarding Congress is the way major pieces of legislation are brought to the floor without Members having an opportunity to read the bills. This is particularly a problem with the Appropriations conference reports, which are often rushed to the floor of the House in late-night sessions at the end of the year. For example, just this past December, the House voted on the Fiscal Year 2006 Defense Appropriations Conference Report at approximately 4 a.m. — just 4 hours after the report was filed. Yet, the report contained language dealing with avian flu, including controversial language regarding immunity liability for vaccine manufacturers, that was added in the House-Senate conference on the bill. Considering legislation on important issues in this manner is a dereliction of our duty as the people’s elected representatives. House of Representatives Introduction Of The Sunlight Rule 2 March 2006 2006 Ron Paul 8:2 My proposed rule requires that no piece of legislation, including conference reports, can be brought before the House of Representatives unless it has been available to Members and staff in both print and electronic version for at least 10 days. My bill also requires that a manager’s amendment that makes substantive changes to a bill be available in both printed and electronic forms at least 72 hours before being voted on. While manager’s amendments are usually reserved for technical changes, oftentimes manager’s amendments contain substantive additions to or subtractions from bills. Members should be made aware of such changes before being asked to vote on a bill. House of Representatives Jack Abramoff Scandal 3 May 2006 2006 Ron Paul 33:1 Mr. PAUL. Mr. Chairman, the public outrage over the Jack Abramoff scandal presented Congress with an opportunity to support real reform by addressing the root cause of the corruption: the amount of money and power located in Washington, D.C. A true reform agenda would focus on ending federal funding for unconstitutional programs, beginning with those programs that benefit wealthy corporations and powerful special interests. Congress should also change the way we do business in the House by passing the Sunlight Rule (H. Res. 709). The Sunlight Rule ensures that members of the House of Representatives and the American public have adequate time to read and study legislation before it is voted upon. Ending the practice of rushing major legislation to the House floor before members have had a chance to find out the details of bills will do more to improve the legislative process and restore public confidence in this institution than will imposing new registration requirements on lobbyists or making staffers waste their time at an “ethics class.” House of Representatives Amending Title 49, United States Code 6 June 2006 2006 Ron Paul 42:2 Some people, including many House of Representatives members with whom I usually agree, are claiming that H.R. 5449 will cost American taxpayers billions of dollars. This claim is based on an assumption that the final result of the mediation process established by H.R. 5449 will be significantly more costly to the taxpayer then the contract the FAA will impose on the controllers if H.R. 5449 fails to pass. However, under H.R. 5449, the dispute will be resolved by a Federal mediation panel whose members are appointed by the president. I am skeptical that a presidentially appointed mediation board will give an exorbitant package to NATCA, especially since the difference between the FAA’s current proposal and the NATCA’s last offer is less than a billion dollars. It is true that a future mediation panel may be populated by people appointed by an administration more friendly to the air traffic controllers than the current administration, but it is also possible that a future Congress would use its leverage in the current process to force the FAA to accept contracts tilted in favor of the NATCA. We should not judge procedural issues based on uncertain predictions about results. I can hardly think of anything more controversial than sending tens of millions of U.S. taxpayer dollars overseas to interfere in the affairs of foreign countries. House of Representatives Statement Introducing American Freedom Agenda Act Of 2007 15 October 2007 2007 Ron Paul 98:3 The legislation clarifies that no information shall be admitted as evidence if it is obtained from the defendant through the use of torture or coercion. It codifies the FISA process as the means by which foreign intelligence may be obtained and it gives members of the Senate and the House of Representatives standing in court to challenge presidential signing statements that declares the president’s intent to disregard certain aspects of a law passed in the U.S. Congress. It prohibits kidnapping and extraordinary rendition of prisoners to foreign countries on the president’s unilateral determination that the suspect is an enemy combatant. It defends the first amendment by clarifying that journalists are not to be prevented from publishing information received from the legislative or executive branch unless such publication would cause immediate, direct, and irreparable harm to the United States. House of Representatives Question Of The Privileges Of The House 6 November 2007 2007 Ron Paul 102:2 I have always been strongly in favor of vigorous congressional oversight of the executive branch, and I have lamented our abrogation of these Constitutional obligations in recent times. I do believe, however, that this legislation should proceed through the House of Representatives following regular order, which would require investigation and hearings in the House Judiciary Committee before the resolution proceeds to the floor for a vote. This time- tested manner of moving impeachment legislation may slow the process, but in the long run it preserves liberty by ensuring that the House thoroughly deliberates on such weighty matters. In past impeachments of high officials, including those of Presidents Nixon and Clinton, the legislation had always gone through the proper committee with full investigation and accompanying committee report. House of Representatives Expressing concern over Russian involvement in Alexander Litvinenko’s murder 1 April 2008 2008 Ron Paul 17:1 Mr. Speaker: I rise in strong opposition to this ill-conceived resolution. The US House of Representatives has no business speculating on guilt or innocence in a crime that may have been committed thousands of miles outside US territory. It is arrogant, to say the least, that we presume to pass judgment on crimes committed overseas about which we have seen no evidence. House of Representatives Expressing concern over Russian involvement in Alexander Litvinenko’s murder 1 April 2008 2008 Ron Paul 17:2 The resolution purports to express concern over the apparent murder in London of a shadowy former Russian intelligence agent, Alexander Litvinenko, but let us not kid ourselves. The real purpose is to attack the Russian government by suggesting that Russia is involved in the murder. There is little evidence of this beyond the feverish accusations of interested parties. In fact, we may ultimately discover that Litvinenko’s death by radiation poisoning was the result of his involvement in an international nuclear smuggling operation, as some investigative reporters have claimed. The point is that we do not know. The House of Representatives has no business inserting itself in disputes about which we lack information and jurisdiction. House of Representatives Statement on H Res 1194, “Reaffirming the support of the House of Representatives for the legitimate, democratically-elected Government of Lebanon under Prime Minister Fouad Siniora.” May 20, 2008 2008 Ron Paul 30:1 Mr. PAUL. Mr. Speaker, I rise in opposition to H. Res. 1194, mainly because this legislation reads like an authorization to use force in Lebanon. As the key resolved clause of H. We are not debating a bill to reverse the odious FISA bill passed recently which will result in extreme abuses of Americans by gutting the Fourth Amendment. First, these laws were never considered to be the domain of the federal government when our founding fathers crafted our constitution. Finally, these laws resemble a repeal of the idea that individuals are "innocent until proven guilty." Civil asset forfeiture allows for the confiscation of property, prior even to any conviction, and this is the issue my amendment specifically addressed. Cached In the past few months, American workers, consumers, and businesses have experienced a sudden and dramatic rise in gasoline prices. In some parts of the country, gasoline costs as much as $4 per gallon. Some politicians claim that the way to reduce gas prices is by expanding the government’s power to regulate prices and control the supply of gasoline. For example, the House of Representatives has even passed legislation subjecting gas stations owners to criminal penalties if they charge more than a federal bureaucrat deems appropriate. Proponents of these measures must have forgotten the 1970s, when government controls on the oil industry resulted in gas lines and shortages. It was only after President Reagan lifted federal price controls that the gas lines disappeared.
