employee Introducing The Privacy Protection Act 25 February 1998 1998 Ron Paul 20:2 Anyone who doubts that we are well on the way to using the Social Security number as an universal identifier need only consult 1996’s welfare reform bill, which forces business to report the Social Security number of every new employee to the federal government so it may be recorded in a national data base. employee Credit Union Membership Access Act 1 April 1998 1998 Ron Paul 33:6 Smaller banks face the highest compliance cost in relation to total assets, equity capital and net income before taxes, reveals Regulatory Burden: The Cost to Community Banks, a study prepared for the Independent Bankers Association of America by Grant Thornton, January 1993. CRA compliance costs for small banks was $1 billion and 14.4 million employee hours in 1991. For each $1 million in assets, banks under $30 million in assets incur almost three times the compliance cost of banks between $30–65 million in assets. This regulation almost quadruples costs on smaller institutions to almost four times when compared to banks over $65 million in assets. These findings are consistent for both equity capital and net income measurements, according to the report. employee Support The National Right To Work Act 6 May 1998 1998 Ron Paul 48:3 Compulsory unionism violates employers’ and employees’ constitutional rights of freedom of contract and association. Congress has no constitutional authority to force employees to pay union dues to a labor union as a condition of getting or keeping a job. employee Parent And Student Saving Account Act 18 June 1998 1998 Ron Paul 62:3 I also support the provisions extending the exclusion of funds received from qualified state tuition programs, and excluding monies received from an employer to pay for an employee’s continuing education from gross income. Both of these provisions allow Americans to spend more of their resources on education, rather than hand their hard-earned money over to the taxman. employee Parent And Student Saving Account Act 18 June 1998 1998 Ron Paul 62:7 In order to offset the so-called “cost to government” (revenue loss) H.R. 2646 alters the rules by which businesses are taxed on employee vacation benefits. While I support efforts to ensure that tax cuts do not increase the budget deficit, the offset should come from cuts in wasteful, unconstitutional government programs, such as foreign aid and corporate welfare. Congress should give serious consideration to cutting unconstitutional programs such as “Goals 2000” which runs roughshod over the rights of parents to control their children’s education, as a means of offsetting the revenue loss to the treasury from this bill. A less than 3% cut in the National Endowment for the Arts budget would provide more funding than needed for the education IRA section of this legislation. employee Drug-Free Workplace Act 23 June 1998 1998 Ron Paul 63:5 Moreover, the Federal Government further makes matters worse by imposing employment regulations which make it difficult to terminate employees who engage in drug or alcohol abuse. Such a regulatory regime further socializes the costs of irresponsibility upon innocents by forcing employers to continue to pay the salaries and/or health benefits of unsavory employees during rehabilitation periods. employee Drug-Free Workplace Act 23 June 1998 1998 Ron Paul 63:6 Private employers should already be free to require drug testing as a condition or term of employment. This legislation, however, unnecessarily brings the Federal Government into this process. The threat of liability law suits will dictate that drug testing will be prevalent in jobs where abstinence from drug use is most critical. However, setting up taxpayer-funded federal programs here are not only unnecessary but ill-advised. The newspapers are replete with examples of various lawsuits filed as a consequence of false positives resulting from both scientific and human errors. This legislation involves the Federal Government so far as to require drug testing be completed by only a few government-favored drug testers. This bill also requires those small businesses who participate to mandatorily test employees for drug and alcohol abuse. This proposition treads dangerously on grounds violative of the fourth amendment. While the bill of rights is a limitation upon actions by the Federal Government, it does not restrict the voluntary actions of private employers and their employees. The case becomes far less clear when the Federal Government involves itself in what should simply be a matter of private contract. In fact, government involvement may actually constitute a hindrance upon employers ability to adequately test those employees for whom they feel testing may be a necessary job component. employee Drug-Free Workplace Act 23 June 1998 1998 Ron Paul 63:7 It should never go unnoticed that, as is so often the case in this Congress, constitutional authority is lacking for the further expansion of the Federal Government into the realm of small business and the means by which they hire reliable employees. The Report on H.R. 3583 cites Article I, Section 8, Clause 18 as the Constitutional authority. This clause reads “To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Office thereof” (emphasis added). The authority cited requires a foregoing Power which not only is missing from the authority cited for this bill but in my close examination of Article I, Section 8, simply seems not to exist. employee Patient Protection Act of 1998 24 July 1998 1998 Ron Paul 84:4 Mr. Speaker, I am also pleased that Congress is addressing the subject of health care in America, for the American health care system does need reform. Too many Americans lack access to quality health care while millions more find their access to medical care blocked by a “gatekeeper,” an employee of an insurance company or a Health Maintenance Organization (HMO) who has the authority to overrule the treatment decisions of physicians! employee Patient Protection Act of 1998 24 July 1998 1998 Ron Paul 84:5 An an OB/GYN with more than 30 years experience, I find it outrageous that any insurance company bureaucrat could presume to stand between a doctor and a patient. However, in order to properly fix the problem, we must understand its roots. The problems with American health care coverage are rooted in the American tax system, which provides incentives for employers to offer first-dollar insurance benefits to their employees, while providing no incentives for individuals to attempt to control their own health care costs. Because “he who pays the piper calls the tune,” it is inevitable that those paying the bill would eventually seize control over personal health care choices as a means of controlling costs. employee Patient Protection Act of 1998 24 July 1998 1998 Ron Paul 84:10 This legislation also allows both employers and employees to contribute to an employee’s MSA. It lifts the arbitrary caps on how one can obtain MSA’s and expands the limits on the MSA deductible. Also it provides that possession of an MSA satisfies all mandated benefits laws as long as individuals have the freedom to purchase those benefits with their MSA. employee Patient Protection Act of 1998 24 July 1998 1998 Ron Paul 84:11 However, as much as I support H.R. 4250’s expansion of MSA’s, I equally object to those portions of the bill placing new federal standards on employer offered health care plans. Proponents of these standards claim that they will not raise cost by more than a small percentage point. However, even an increase of a small percentage point could force many marginal small businesses to stop offering health care for their employees, thus causing millions of Americans to lose their health insurance. This will then lead to a new round of government intervention. Unlike Medical Savings Accounts which remove the HMO bureaucracy currently standing between physicians and patients, the so-called patient protections portions of this bill add a new layer of government-imposed bureaucracy. For example, H.R. 4250 guarantees each patient the right to external and internal review of insurance company’s decisions. However, this does not empower patients to make their own decisions. If both external and internal review turn down a patient’s request for treatment, the average patient will have no choice but to accept the insurance companies decision. Furthermore, anyone who has ever tried to navigate through a government-controlled “appeals process” has reason to be skeptical of the claims that the review process will be completed in less than three days. Imposing new levels of bureaucracy on HMO’s is a poor substitute for returning to the American people the ability to decide for themselves, in consultation with their care giver, what treatments are best for them. Medical Savings Accounts are the best patient protection. employee National Provider ID 8 October 1998 1998 Ron Paul 115:8 The National Standard Employer Identifier will require employers to record employees’ private health transactions in a database. This will allow coworkers, hackers, government agents and other unscrupulous persons to access the health transactions of every employee in a company simply by typing the company’s identifier into their PC! employee Freedom And Privacy Restoration Act 6 January 1999 1999 Ron Paul 1:6 Since the creation of the Social Security number in 1935, there have been almost 40 congressionally-authorized uses of the Social Security number as an identification number for non-Social Security programs! Many of these uses, such as the requirement that employers report the Social Security number of new employees to the “new hires data base,” have been enacted in the past few years. In fact, just last year, 210 members of Congress voted to allow states to force citizens to produce a Social Security number before they could exercise their right to vote. employee Introducing The Davis-Bacon Repeal Act 11 February 1999 1999 Ron Paul 7:6 In addition to opening up new opportunities in the construction industry for smaller construction firms and their employees, repeal of Davis-Bacon would also return common sense and sound budgeting to federal contracting which is now rife with political favoritism and cronyism. An audit conducted earlier this year by the Labor Department’s Office of the Inspector General found that inaccurate data were frequently used in Davis-Bacon wage determination. Although the Inspector General’s report found no evidence of deliberate fraud, it did uncover material errors in five states’ wage determinations, causing wages or fringe benefits for certain crafts to be overstated by as much as $1.08 per hour! employee Introducing The Davis-Bacon Repeal Act 11 February 1999 1999 Ron Paul 7:8 Mr. Speaker, it is time to finally end this patently unfair, wildly inefficient and grossly discriminatory system of bidding on federal construction contracts. Repealing the Davis-Bacon Act will save taxpayers billions of dollars on federal construction costs, return common sense and sound budgeting to federal contracting, and open up opportunities in the construction industry to those independent contractors, and their employees, who currently cannot bid on federal projects because they cannot afford the paperwork requirements imposed by this act. I, therefore, urge all my colleagues to join me in supporting the Davis-Bacon Repeal Act of 1999. employee Health Care Reform: Treat The Cause, Not The Symptom 4 October 1999 1999 Ron Paul 103:23 The ERISA law requiring businesses to provide particular programs for their employees should be repealed. For years it was known that some insurance policies excluded certain care and this was known up front and was considered an acceptable provision since it allowed certain patients to receive discounts. The federal government should defer to state governments to deal with the litigation crisis and the need for contract legislation between patients and medical providers. Health care providers should be free to combine their efforts to negotiate effectively with HMOs and insurance companies without running afoul of federal anti-trust laws — or being subject to regulation by the National Labor Relations Board (NLRB). Congress should also remove all federally-imposed roadblocks to making pharmaceuticals available to physicians and patients. Government regulations are a major reason why many Americans find it difficult to afford prescription medicines. Most recently the NLRB established a new nationwide rule that union officials may force employees to pay for union organizing drives as a condition of employment — directly contradicting several Supreme Court rulings! employee Statement on OSHA Home Office Regulations January 28, 2000 2000 Ron Paul 1:1 Mr. Chairman, I appreciate the opportunity to express my concerns regarding the possibility that the Occupational Safety and Health Administration (OSHA) will attempt to exercise regulatory authority over home-based worksites and hold employers responsible for accidents occurring in such worksites. Although OSHA has announced that it will only hold employers liable for conditions at home-based worksites if the employee is performing “hazardous manufacturing work,” this proposal still raises serious concerns. This is because any expansion of OSHAs regulatory authority in the homes represents a major expansion of federal authority far beyond anything intended by Congress when it created OSHA in the 1970s. Furthermore, OSHA regulation of any type of work in the private residence opens the door to the eventual regulation of all home worksites. In order to ensure home-based workers are protected from overzealous federal bureaucrats, Congressman J.D. Hayworth (R-AZ) and myself have introduced legislation, the Home Office Protection Enhancement (HOPE) Act, amending the Occupational Safety and Health Act to clarify that OSHA has no authority over worksites located in an employee’s residence. employee Statement on OSHA Home Office Regulations January 28, 2000 2000 Ron Paul 1:2 Modern technology, such as e-mail and the Internet, allows employees to be productive members of the workforce without leaving their homes! The option of “telecommuting” is particularly valuable for women with young children or those caring for elderly parents. Using technology to work at home gives these Americans the chance to earn a living and have a fulfilling career while remaining at home with their children or elderly parents. Telecommuting also makes it easier for citizens with disabilities to become productive members of the job market. Any federal requirements holding employers liable for the conditions of a home office may well cause some employers to forbid their employees from telecommuting, thus shutting millions of mothers, persons caring for elderly parents, and disabled citizens out of the workforce! employee Statement on OSHA Home Office Regulations January 28, 2000 2000 Ron Paul 1:3 Federal polices discouraging telecommuting will harm the environment by forcing American workers out of their home and onto America’s already overcrowded roads. It is ironic that an administration, which has claimed that “protecting the environment” is one of its top priorities, would even consider policies that could undermine a market-created means of protecting the environment. Employers who continue to allow their employees to telecommute will be forced by any OSHA regulations on home offices to inspect their employees’ homes to ensure they are in compliance with any and all applicable OSHA regulations. This is a massive invasion of employees’ privacy. What employee would want their boss snooping around their living room, den, or bedroom to make sure their “home-based worksite” was OSHA compliant? employee Statement on OSHA Home Office Regulations January 28, 2000 2000 Ron Paul 1:4 Mr. Chairman, the fact that OSHA would even consider exercising regulatory authority over any part of a private home shows just how little respect OSHA has for private property. Private property, of course, was considered one of the bulwarks of liberty by our nation’s founding fathers, and has been seriously eroded in this country. While it is heartening that so many members of Congress have expressed their displeasure with OSHA over this issue, I am concerned that most of the debate has focused on the negative consequences of this regulation instead of on the question of whether OSHA has the constitutional authority to regulate any part of a private residence (or private business for that matter). The economic and social consequences of allowing federal bureaucrats to regulate home offices certainly should be debated. However, I would remind my colleagues that conceding the principle that the only way to protect worker safety is by means of a large bureaucracy with the power to impose a “one-size fits all” model on every workplace in America ensures that defenders of the free market will be always on the defensive, trying to reign in the bureaucracy from going “too far” rather than advancing a positive, pro-freedom agenda. Furthermore, many companies are experiencing great success at promoting worker safety by forming partnerships with their employees to determine how best to create a safe workplace. This approach to worker safety is both more effective, and constitutionally sound, than giving OSHA bureaucrats the power to, for example, force landscapers to use $200 gas cans instead of $5 cans or fining a construction company $7,000 dollars because their employees jumped in a trench to rescue a trapped man without first putting on their OSHA-approved hard hats; or fine a company because it failed to warn employees not to eat copier toner! employee MINIMUM WAGE INCREASE ACT March 9, 2000 2000 Ron Paul 15:1 * Mr. Speaker, I appreciate the opportunity to explain why I oppose the H.R. 3846, a bill to raise the federally-mandated minimum wage. Raising living standards for all Americans is an admirable goal, however, to believe that Congress can raise the standard of living for working Americans by simply forcing employers to pay their employees a higher wage is equivalent to claiming that Congress can repeal gravity by passing a law saying humans shall have the ability to fly. employee MINIMUM WAGE INCREASE ACT March 9, 2000 2000 Ron Paul 15:4 * Furthermore, interfering in the voluntary transactions of employers and employees in the name of making things better for low wage earners violates citizens’ rights of association and freedom of contract as if to say to citizens ‘you are incapable of making employment decisions for yourself in the marketplace.’ employee MINIMUM WAGE INCREASE ACT March 9, 2000 2000 Ron Paul 15:7 * I am also cosponsoring the Make College Affordable Act (H.R. 2750), which makes college tuition tax deductible for middle-and-working class Americans, as well as several pieces of legislation to provide increased tax deductions and credits for education savings accounts for both higher education and K-12. In addition, I am cosponsoring several pieces of legislation, such as H.R. 1824 and H.R. 838, to provide tax credits for employers who provide training for their employees. employee MINIMUM WAGE INCREASE ACT March 9, 2000 2000 Ron Paul 15:9 * However, Mr. Speaker, Congress should not fool itself into believing that the package of small business tax cuts will totally compensate for the damage inflicted on small businesses and their employees by the minimum wage increase. This assumes that Congress is omnipotent and thus can strike a perfect balance between tax cuts and regulations so that no firm, or worker, in the country is adversely effected by federal policies. If the 20th Century taught us anything it was that any and all attempts to centrally plan an economy, especially one as large and diverse as America’s, are doomed to fail. employee Statement of Ron Paul on the Misuse of the Social Security Number May 11, 2000 2000 Ron Paul 35:4 Since the passage of the Privacy Act, Congress has been all too eager to expand the use of the Social Security number as a uniform identifier. In fact, those supporting it should be disgraced to learn that, among other misgivings, this bill, further undermines U.S. sovereignty by empowering the World Trade Organization on the backs of American taxpayers, sends federal employees to Beijing to become lobbyists to members of their communist government to become more WTO-friendly, funds the imposition of the questionable Universal Declaration of Human Rights upon foreign governments, and authorizes the spending of nearly $100 million to expand the reach of Radio Free Asia. employee Hostettler Amendment to Commerce, Justice, State, Judiciary Appropriations Act June 26, 2000 2000 Ron Paul 59:8 * The BATF will require all employees of dealers to attend annual training courses. In these training courses, the BATF gives the final say as to what can be taught and what will be excluded. Each employee must also complete an examination of which its contents will be closely reviewed by the oversight commission and make its own changes as it sees fit. In essence, they are acting as the ‘thought-control’ police. This sounds very Orwellian to me and far from what Patrick Henry had in mind when he said, ‘The great objective is that every man be armed . . . Everyone who is able may have a gun.’ employee THE FAMILY HEALTH TAX CUT ACT 29 June 2000 2000 Ron Paul 62:2 * The tax credits provided in this bill will be especially helpful to those Americans whose employers cannot afford to provide their employees health insurance. These workers must struggle to meet the medical bills of themselves and their families. This burden is especially heavy on parents whose children have a medical condition, such as cancer or a physical disability, which requires long-term or specialized health care. employee Child Support Distribution Act Of 2000 September 7, 2000 2000 Ron Paul 71:2 * I am particularly disturbed by the language expanding the use of the National Directory of New Hires, popularly known as the ‘new hires database’, in order to more effectively administer the unemployment compensation system and deny visas and residency to non-citizens who are delinquent in child support payments. Identifying persons who are failing to fulfill their legal obligation to pay child support is a worthy goal, as an OB-GYN who has delivered over four thousand babies in my over thirty year medical career, words cannot express the contempt I hold for those who would refuse to support their children. Similarly, preventing fraud in the unemployment program is obviously important to the nation’s employers and employees whose taxes finance the unemployment insurance system. employee INTRODUCTION OF THE ESSENTIAL RURAL HOSPITAL PRESERVATION ACT September 20, 2000 2000 Ron Paul 78:4 * 1. A wage index for Essential Service Hospitals set at 1.0 — Essential Service Hospitals receive 26 percent less Medicare Reimbursement than hospitals in MSA area. This places rural areas at disadvantage in competing for high-quality employees with hospitals in urban areas. Setting the wage index at 1.0 will enhance the ability of rural hospitals to attract the best personal and thus ensure residents of rural areas can continue to receive quality health care. employee CHILDHOOD CANCER AWARENESS MONTH September 21, 2000 2000 Ron Paul 79:2 * The bill will be particularly helpful to those parents whose employers cannot afford to provide their employees’ health insurance. Often-times those employees work in low-income jobs and thus must struggle to provide adequate health care for their children. This burden is magnified when the child needs special care to cope with cancer or a physical disability. Yet, thanks to Congress’ refusal to grant individuals the same tax breaks for health-care expenses it grants businesses, these hard-working parents receive little or no tax relief to help them cope with the tremendous expenses of caring for a child requiring for a child requiring long-term or specialized care. employee CONFERENCE REPORT ON H.R. 2615, CERTIFIED DEVELOPMENT COMPANY PROGRAM IMPROVEMENTS ACT OF 2000 October 26, 2000 2000 Ron Paul 92:9 * The small business tax relief in this bill is more than outweighed by the provisions raising the federally-mandated minimum wage. While I certainly understand the motivation to help lower wage workers, the reality is that a minimum wage hike hurts lower income Americans the most. When an employer cannot afford to pay a higher wage, the employer has no choice but to hire less workers. As a result, young people with fewer skills and less experience find it harder to obtain an entry-level job. Raising the minimum wage actually reduces opportunities and living standards for the very people the administration claims will benefit from this legislation! It’s time to stop fooling ourselves about the basic laws of economics, and realize that Congress cannot legislate a higher standard of living. Congress should not allow itself to believe that the package of small business tax cuts will fully compensate businesses and their employees for the damage inflicted by a minimum wage hike. Congress is not omnipotent; we cannot pretend to strike a perfect balance between tax cuts and wage mandates so that no American businesses or workers are harmed. It may make my colleagues feel good to raise the minimum wage, but the real life consequences of this bill will be felt by those who can least afford diminished job opportunities. employee Blame Congress for HMOs February 27, 2001 2001 Ron Paul 15:28 To bring the privately insured into HMOs, Congress forced employers with 25 or more employees to offer HMOs as an option — a law that remained in effect until 1995. Congress then provided a total of $373 million in federal subsidies to fund planning and startup expenses, and to lower the cost of HMO premiums. This allowed HMOs to undercut the premium prices of their insurance competitors and gain significant market share. employee Blame Congress for HMOs February 27, 2001 2001 Ron Paul 15:30 The combined strategy of subsidies, federal power, and new legal requirements worked like a charm. Employees searching for the lowest priced comprehensive insurance policy flowed into HMOs, bringing their dollars with them. According to the Health Resources Services Administration (HRSA), the percentage of working Americans with private insurance enrolled in managed care rose from 29 percent in 1988 to over 50 percent in 1997. In 1999, 181.4 million people were enrolled in managed-care plans. employee “Postal Service Has Its Eye On You” 27 June 2001 2001 Ron Paul 47:1 Mr. PAUL. Mr. Speaker, I am pleased to take this opportunity to draw my colleagues’ attention to the attached article “Postal Service Has Its Eye On You” by John Berlau of Insight magazine, which outlines the latest example of government spying on innocent citizens. Mr. Berlau deals with the Post Office’s “Under the Eagle’s Eye” program which the Post Office implemented to fulfill the requirements of the Nixon-era Bank Secrecy Act. Under this program, postal employees must report purchases of money orders of over $3,000 to federal law enforcement officials. The program also requires postal clerks to report any “suspicious behavior” by someone purchasing a money order. Mr. Speaker, the guidelines for reporting “suspicious behavior” are so broad that anyone whose actions appear to a postal employee to be the slightest bit out of the ordinary could become the subject of a “suspicious activity report,” and a federal investigation! employee “Postal Service Has Its Eye On You” 27 June 2001 2001 Ron Paul 47:2 As postal officials admitted to Mr. Berlau, the Post Office is training its employees to assume those purchasing large money orders are criminals. In fact, the training manual for this program explicitly states that “it is better to report many legitimate transactions that seem suspicious than let one illegal one slip through.” This policy turns the presumption of innocence, which has been recognized as one of the bulwarks of liberty since medieval times, on its head. Mr. Speaker, while H.R. 2830, the Pension Protection Act of 2005, is not perfect, it does decrease the risk that employees will be deprived of pension benefits they were promised as part of their employment contracts. H.R. 2830 also decreases the likelihood that American taxpayers will be forced to bailout private pensions, and reduces the tax burden on American workers to provide them with greater incentives and opportunities to save for their own retirements. Therefore, I will vote for this bill on final passage. employee Pension Protection Act 15 December 2005 2005 Ron Paul 126:2 However, I oppose this rule, because I do not like the process under which this bill is being brought to the floor. The rule before us today does not allow any member to offer, or vote on, amendments that may improve this bill. In particular, I was hoping to vote on an amendment protecting United Airline retirees from having their pension benefits reduced or terminated even though United expects to make $1 billion in profit within 1 year of being discharged from bankruptcy. The Senate version of the bill does address same problems of the airline industry. However it fails to protect United Airlines retirees. The Federal Government should not facilitate a large companies getting out of its contractual obligations to their retired workers. I, therefore, urge my colleagues to protect the pensions of retired United Airline employees by rejecting this rule and voting for a rule that allows us to consider adding, language helping the United Airline retirees to the bill. If this rule does pass, I urge my colleagues to move the process foreword by voting for the bill and working to add language protecting the United Airline pilots to the bill when it goes to conference with the Senate. employee Amending Title 49, United States Code 6 June 2006 2006 Ron Paul 42:1 Mr. PAUL. Mr. Speaker, H.R. 5449 changes the rules under which the Federal Aviation Administration (FAA) negotiates with Federal employees unions, such as the National Air Traffic Controllers Association (NATCA), to make the FAA abide by the exact same process that other government agencies do when they negotiate with Federal employees unions. Contrary to the claims of its opponents, H.R. 5449 does not allow NATCA to indefinitely prolong negotiations. H.R. 5449 allows the FAA to act to end negotiations and bring their case before a Federal mediation board who has power to resolve the dispute. H.R. 5449 would prevent the FAA from unilaterally imposing a contract on the air traffic controllers. In contrast, the current system may provide the FAA with the opportunity to drag out negotiations, so it can ultimately declare an impasse and impose a contract. Thus, the changes made in H.R. 5449 seem reasonable. employee Amending Title 49, United States Code 6 June 2006 2006 Ron Paul 42:4 In conclusion, Mr. Speaker, H.R. 5449 reasonably changes the process under which the FAA negotiates with Federal employees unions. Uniform Federal mandates are a clumsy and ineffective way to deal with problems such as employers making hiring decisions on the basis of a potential employee’s genetic profile. Imposing Federal mandates on private businesses merely raises the costs of doing business and thus reduces the employment opportunities for all citizens. A much better way to eliminate irrational discrimination is to rely on state and local regulation. Unlike the Federal Government, states and localities are able to tailor their regulations to fit the needs of their particular populaces. I would remind my colleagues that 34 states currently ban genetic discrimination in employment, while 46 states forbid health insurers from engaging in genetic discrimination. Clearly, the states are capable of addressing this issue without interference from Washington. With cooperation from other area papers, the Herald Zeitung in New Braunfels for layout and the Victoria Advocate for printing, every single issue promised readers will be available to them, even if some homes have been impossible to deliver to. I am also told that many reporters and employees of the paper endured heavy personal losses. They obviously consider their roles as communicators within and for the community of Galveston not as a mere job, but as a personal calling. I have spoken with patients who have suffered from these illnesses, which put such a terrible strain on them and their loved ones. Even when they have health care coverage (and many do not), they still incur all kinds of costs ranging from transportation to and from care centers and certain prescription drugs which may not be fully covered, to hiring sitters to watch their children while they receive treatment. The list is nearly endless. In the legislation I introduced, if the disease goes into remission and all related costs are paid, the employee would again resume paying the payroll tax. This is a conservative program designed to reduce the tax burden of those fighting these dreaded illnesses. Cached The bill contains other worthy provisions. "Pension portability" is enhanced, making it easier for employees who change jobs more often in today's economy to move their pension savings to another type of plan. This is accomplished by relaxing the "roll-over" rules, which dictate the time in which individuals may make a tax-free transfer of their pension when they start a new job. Americans over 50 also benefit from the "catch-up" provisions contained in the bill. Individuals 50 and over may contribute $5,000 to their IRAs immediately beginning in 2001, in addition to the amount that they would otherwise be allowed to contribute. Thus, by 2003 such an individual could contribute a total of $10,000 to an IRA. Compassion and common sense require that we adopt a policy that stops taking needed resources away from those suffering from terrible health problems. Specifically, the Act provides parents caring for a child with a disability, cancer, terminal illness, or other condition requiring specialized medical care with a tax credit of up to $3,000. Our tax laws permit businesses to deduct employee health care costs from their income taxes; surely families should be permitted the same deduction to free up more of their financial resources to pay for the medical bills of their seriously ill children. Cached Several years ago, a constituent of mine was victimized by an unscrupulous insurance company employee. Unknown to my constituent at the time, the thief obtained her Social Security number and stole her identity. The thief applied for credit cards, took out loans, and wrote bad checks, all using her name. Her credit rating was ruined, and she found herself unable to get a job in her chosen field of law enforcement because felonies committed by the thief showed up on background checks. After years of fighting with credit agencies, state authorities, and the Social Security administration, she still has not completely cleared her name. employee "Buy American," Unless... 12 February 2001 Texas Straight Talk 12 February 2001 verse 6 ... Cached The ultimate result of our embargo policies is obvious: when our government prevents American companies from selling their goods abroad, it creates an economic hardship for those companies and their employees. Similarly, when the government prevents American consumers from buying the goods or services they want from certain countries, it simply diminishes the living standards of those Americans. Washington intervention in international trade only benefits certain special interests for a short time. In the long run, the vast majority of American citizens and businesses would benefit from unfettered access to all foreign markets. An example is the relatively unregulated software industry, where American companies absolutely dominate the global marketplace. Americans don't need help competing, but they do need a government which does not hinder their access to foreign markets. By following the current policy of government-managed trade and special interest favoritism, Congress is harming the constituents it was elected to represent. The sooner we adopt policies which promote free exchange with all nations, the better off our nation and its people will be. employee IRS Church Seizure is a Tragedy for Religious Liberty 26 February 2001 Texas Straight Talk 26 February 2001 verse 4 ... Cached Amazingly, the tax dispute arose not over a failure to pay income taxes per se, but rather over the failure of the IBT to follow tax withholding rules. The tax code forces all employers, including churches, to act as collection agents for the IRS by presumptively withholding a portion of every employee's paycheck for federal taxes. The IBT steadfastly has refused to withhold taxes from its employees, arguing that religious beliefs prevent it from acting as an agent for a secular government agency. Two important facts have been largely overlooked in the ensuing controversy. First, the IBT (unlike most churches) also refused tax benefits available to it through registration as a tax-exempt religious organization. Second, more than 60 present and former IBT employees successfully passed IRS audits, meaning they paid in full taxes the IBT had not withheld. So the heart of the dispute really was about IBT's principled refusal to do the government's bidding. The real motivation behind the IRS seizure was not to satisfy a tax bill, but rather to set an example for any other churches that might dare to question their obligation to act as tax collectors. employee "Patients Bill of Rights" or Federal Takeover of Medicine? 02 July 2001 Texas Straight Talk 02 July 2001 verse 5 ... Cached So what should we do about the HMO mess? Before we call for government action, we should recognize that the federal government has virtually mandated HMOs on the American people First, the tax code excludes health insurance from taxation when purchased by an employer, but not when purchased by an individual. Second, the HMO Act of 1973 forced all but the smallest employers to offer HMOs to their employees. So while many in Congress are happy to criticize HMOs today, the public never hears how the present system was imposed upon the American people by federal law. In fact, one very prominent Senator now attacking managed care is on record in the 1970s lauding HMOs as "effective and efficient mechanisms for delivering health care of the highest quality." As usual, government intervention in the private market has caused unintended consequences, but Washington blames only the HMOs themselves- not the laws that created them. employee "Patients Bill of Rights" or Federal Takeover of Medicine? 02 July 2001 Texas Straight Talk 02 July 2001 verse 6 ... Cached Not surprisingly, the loudest voices on Capitol Hill now calling for a so-called "patients bill of rights" don't want to abolish the HMO mandate. Instead, more government is proposed to fix the problem. Congress wants to micromanage the system, deciding what treatments and drugs should be paid for by health insurers. Congress also wants to create new rules allowing lawsuits against employers when the HMO refuses treatment to an employee! Surely the trial lawyers will support the new laws, but Americans certainly should understand that more federal involvement will only increase the cost of health insurance for everyone. Undoubtedly, lower-paid workers will find themselves completely uninsured when their premiums increase beyond affordable levels. The truth is that any new legislation will only serve to increase government involvement in our health care system, to the detriment of us all. Without question, the true goal of some in Congress is to create a socialized medicine system. It's politically expedient to slap a "patients rights" label on legislation which simply leads us closer to a complete government takeover of medicine. employee Congressional Spending Threatens your Retirement 27 August 2001 Texas Straight Talk 27 August 2001 verse 7 ... Cached The spendthrift Congress also raids Social Security to pay for a wide variety of completely unrelated pork barrel programs. In fact, this practice has become commonplace over the last decade. Congress consistently wants to spend more than the Treasury collects in general revenues each year, even in boom times when revenues are very high. At the same time, every administration is eager to claim a balanced budget. So Congress uses simple accounting tricks and spends your retirement dollars to fund an ever-growing list of programs, agencies, and federal employees. This practice amounts to nothing more than stealing from our nation's senior citizens, who spent their entire working lives paying into the Social Security system. employee What Should Government Do for the Airlines? 24 September 2001 Texas Straight Talk 24 September 2001 verse 7 ... Cached I also cannot support proposed legislation that simply provides corporate welfare for the airlines at the behest of industry lobbyists. The federal government has no business insuring that massive CEO salaries remain in effect while rank-and-file employees face layoffs and loss of medical benefits. It would be outrageous for the government to give taxpayer dollars to the airlines without insisting that the money be used for basic operations and safety issues. Cached FAA regulations effectively prohibit flight crews from carrying weapons. Although airlines technically may send employees to FAA-conducted seminars to obtain permits, no such seminars have ever been held. Cached The recent bankruptcy filing by Enron has shaken the economy, with investors, employees, and creditors losing billions in a few short months. The shocking and sudden demise of America's seventh-largest company raises serious issues about stock valuations and the financial health of America's big companies. Questions are being raised about improprieties on the part of Enron management and its accounting firm. If evidence of fraud or other criminal activity exists, management and auditors should of course be held responsible. People are understandably angry, especially those who suffered serious financial losses. However, we should be careful not to blame the free market for the actions of a few in what is actually a very highly regulated market. employee Stimulus or Spending? 24 December 2001 Texas Straight Talk 24 December 2001 verse 4 ... Cached It's important to cut through the rhetoric surrounding the stimulus debate over the last few weeks. The only real and lasting way to stimulate the economy is to reduce the amount of money government takes out of the private economy. The only way to do this is by cutting taxes. When taxes are reduced on individuals, they have more money to spend, save, or invest. When taxes are reduced on companies, they have more money to hire new employees, increase wages, or pay dividends to investors. Since all economic growth depends on private capital, the goal of any economic stimulus plan must be to leave more private capital in the hands of investors. When too much American wealth is tied up in government coffers, investment and job growth suffer. This is exactly what we have seen over the past 18 months- the Treasury "surplus" touted by the last administration actually represents a tax overcharge that dragged the economy down well before September 11th. employee Enron: Under-Regulated or Over-Subsidized? 28 January 2002 Texas Straight Talk 28 January 2002 verse 9 ... Cached This does not mean Enron is to be excused. There seems to be little question that executives at Enron deceived employees and investors, and any fraudulent conduct should of course be fully prosecuted. Yet we should not allow criminal fraud in one company, which constitutionally is a matter for state law, to justify the imposition of burdensome new accounting and stock regulations. We certainly should not allow the Enron collapse to be characterized as a failure of capitalism or free markets, because the opposite is true. The Enron collapse provides an example of how government does so much to prevent the market from working properly in the first place. employee The Truth about Government Debt 11 March 2002 Texas Straight Talk 11 March 2002 verse 7 ... Cached Debt and credit, wisely used, can be proper tools for individuals and businesses. After all, individuals often want to expand by starting families and buying houses, while businesses want to expand by hiring more employees and increasing their capacity. In a free society, however, we can never view expansion as a proper goal for government. Unlike a private sector business, our federal government should not be seeking out new ways to increase the scope of its dubious "services." Any government that consumes 40% of the most productive economy in the world and still can't balance its books is a government that vastly overspends. A cursory examination of the annual appropriations bills reveals incredible amounts of unconstitutional, wasteful, and truly unnecessary spending. This uncontrolled spending allows government to grow far beyond its proper constitutional parameters, while also threatening the very solvency of future generations. So I disagree with the supply-side argument that government debt doesn't matter. The issue is not whether the Treasury has sufficient current income to service the debt, but rather whether a government that spends so much is leading us to ruin. Debt does matter, especially to future generations that will be asked to pay for our extravagance. employee Securing the Homeland? 08 July 2002 Texas Straight Talk 08 July 2002 verse 3 ... Cached Real homeland security must focus on consolidation of federal agency resources, better intelligence gathering, and elimination of red tape and bureaucratic turf battles that prevent proper sharing of information. Cached Late Friday evening, after only a few short hours of debate, Congress passed legislation creating a new Department of Homeland Security. The new department represents the biggest government reorganization since the creation of the Department of Defense in the 1940s, and potentially the single biggest expansion of the federal government in our history. Over 175,000 federal employees will be part of the new DHS, and if history is any guide, it will take decades to get all of them working together even marginally. In fact, some estimate that the process of buying and leasing new offices, moving existing offices, and getting all of the new DHS personnel using the same computer and phone systems could take twenty years. Cached Similarly, Congress recently passed a resolution calling for a change in veteran’s disability payments. Currently, retired soldiers may only receive either their military pension or military disability benefits- not both. Nonmilitary government retirees and private sector employees, however, do receive both standard pensions and disability pay. This is very unfair to military retirees, who deserve pay for both their career work and the separate incident that caused their disability. Cached The last time Congress attempted a similarly ambitious reorganization of the government was with the creation of the Department of Defense in 1947. Back then, congressional hearings on the matter lasted two years before President Truman finally signed legislation. Even after this lengthy deliberation, however, organizational problems with the new department lasted more than 40 years! What do we expect from a huge bureaucracy conceived virtually overnight, by a Congress that didn’t even read the bill that creates it? Cached When the Homeland Security department first was conceived, some congressional leaders and administration officials outrageously told a credulous rank-and-file Congress that the new department would be "budget neutral." The agency simply would be a reorganization of existing federal employees, we were told, and would not increase the federal budget. In fact, the agency was touted as increasing efficiency, rather than expanding federal power. Of course the original 32 page proposal sent over by the White House quickly grew to 282 pages in House committees, ending up at more than 500 pages in the final version voted on last week- with a $3 billion price tag just for starters. The sheer magnitude of the bill, and the technical complexity of it, makes it impossible for anyone to understand completely. Rest assured that the new department represents a huge increase in the size and scope of the federal government that will mostly serve to spy on the American people. Laughably, the new department has been characterized as merely a "reorganization" of existing agencies, even though I notice no department was abolished to make up for it! One thing we can be sure of in this world is that federal agencies grow. The Homeland Security department, like all federal agencies, will increase in size exponentially over the coming decades. Its budget, number of employees, and the scope of its mission will EXPAND. It provides a perverse incentive for private plans to dump seniors into the government plan, and some companies with large numbers of retirees have already announced their intention to do so. The Joint Economic Committee estimates that nearly 40% of private plans will stop providing prescription drug coverage because of the new Medicare plan. Cached Problems within TSA are legion. In the rush to hire a new workforce, 28,000 screeners were put to work without background checks. Some of them were convicted felons. Many were very young, uneducated, with little job experience. At Kennedy and LaGuardia airports in New York, police arrested dozens of TSA employees who were simply stealing valuables from the luggage they were assigned to inspect. Of course TSA has banned locks on checked luggage, leaving passengers with checked bags totally at the mercy of screeners working behind closed doors. But airlines are finding out the hard way that millions of Americans simply won't put up with TSA's abuse. HR 3078 waives the employee portion of Social Security payroll taxes (or self-employment taxes) for individuals with documented serious illnesses or cancer. It also suspends Social Security taxes for primary caregivers with a sick spouse or child. Cached Though some opponents claimed that the only controversial part of this legislation was its grant of immunity to telecommunications companies, there is much more to be wary of in the bill. In the House version, Title II, Section 801, extends immunity from prosecution of civil legal action to people and companies including any provider of an electronic communication service, any provider of a remote computing service, “any other communication service provider who has access to wire or electronic communications,” any “parent, subsidiary, affiliate, successor, or assignee” of such company, any “officer, employee, or agent” of any such company, and any “landlord, custodian, or other person who may be authorized or required to furnish assistance.” The Senate version goes even further by granting retroactive immunity to such entities that may have broken the law in the past.
