Congress Relinquishing The Power To Wage War

Initially the Articles of Confederation spoke clearly of just who would be responsible for waging war. It gave the constitutional Congress, quote, sole and exclusive right and power of determining on peace and war. In the debate at the Constitutional Convention it was clear that this position was maintained as the power of the British king was not to be, quote, a proper guide in defining executive war powers, close quote, for the newly formed republic. The result was a Constitution that gave Congress the power to declare war, issue letters of mark and reprisal, call up the militia, raise and train an Army and Navy and regulate foreign commerce, a tool often used in international conflict. The President was also required to share power with the Senate in ratifying treaties and appointing ambassadors.

It is said that we do not have this authority; that we should give it to the President; that he has it under the Constitution based on his authority to formulate foreign policy. It is not there. The Congress has the responsibility to declare war, write letters of marks and reprisals, call up the militia, raise and train army and regulate foreign commerce. The President shares with the Senate treaty power as well as appointment of ambassadors. The President cannot even do that alone.

The War On Terrorism

Granting bailouts is not new for Congress, but current conditions have prompted many takers to line up for handouts. There has always been a large constituency for expanding federal power for whatever reason, and these groups have been energized. The military-industrial complex is out in full force and is optimistic. Union power is pleased with recent events and has not missed the opportunity to increase membership rolls. Federal policing powers, already in a bull market, received a super shot in the arm. The IRS, which detests financial privacy, gloats, while all the big spenders in Washington applaud the tools made available to crack down on tax dodgers. The drug warriors and anti-gun zealots love the new powers that now can be used to watch the every move of our citizens. “Extremists” who talk of the Constitution, promote right-to-life, form citizen militias, or participate in non-mainstream religious practices now can be monitored much more effectively by those who find their views offensive. Laws recently passed by the Congress apply to all Americans- not just terrorists. But we should remember that if the terrorists are known and identified, existing laws would have been quite adequate to deal with them.

Our continued occupation of Iraq is not producing the promised results, despite efforts to paint a brighter picture of the current situation. What once was a secular dictatorship appears to be moving toward being a fundamentalist Islamic regime – not the democracy we were promised. As repulsive as Saddam’s regime was, the prospect of an Iraq run by Islamic clerics, aligned with Iranian radicals and hostile to the United States, is no more palatable. There are signs that this is the trend. The press reports regularly on attacks against Iraq’s one million Christians. Those hand-picked by the United States to run Iraq have found themselves targets for assassination. Clerics are forming their own militias. The thousands of non-combatants killed in the US intervention are seeking revenge against the unwanted American occupiers.

The claim that our immediate withdrawal from Iraq would cause chaos is not proven. It didn’t happen in Vietnam or even Somalia. Even today, the militias of the Kurds and the Shiites may well be able to maintain order in their regions much better than we can currently. Certainly the Sunnis can take care of themselves, and it might be in their best interests for all three groups not to fight each other when we leave. One thing for sure: if we left no more young Americans would have to die for an indefinable cause.

The real problem with our plans to train a faction of Iraqis to carry out our plans for the Middle East is that the majority of Iraqis object and the army trainees are not as motivated as are the members of the various militias. The Kurds have a militia capable of maintaining order in their region. Sadr has a huge militia that is anxious to restore order and have us gone. The Badr brigade is trained to defend its interests. And the Sunnis are armed and determined. Our presence only serves to stir the pot by our troops being a target of nearly all the groups who are positioning themselves for our anticipated departure.

It makes little sense to assert that Iran is funding militias to undermine the Iraqi government. The current Iraqi government may have been approved by the United States, but essentially it was made in Iran. The leading political parties of Iraq, the DAWA and the Supreme Islamic Iraqi Council have close ties to Iran. Leaders of these parties were in exile in Iran until the US invasion of Iraq. Iranian president Ahmadinejad is warmly welcomed in Baghdad by Iraqi Prime Minister Maliki. Why would Iran set up militias in the south to destabilize a government with such strong Iranian ties? I find the allegation that Iran just cannot tolerate an elected government next door to be unsatisfying, particularly considering that Iran itself regularly holds elections where a wide variety of political parties compete for power.

Imagine the national media coverage, and resulting public outrage, if a minority church was seized over a refusal to pay taxes. In the 1700s, militias were local groups made up of ordinary citizens. They were not under federal control! As a practical matter, many of them were barely under the control of colonial or state authorities. When the 2nd Amendment speaks of a "well-regulated militia," it means local groups of individuals operating to protect their own families, homes, and communities. They regulated themselves because it was necessary and in their own interest to do so.

Iraq war supporters claim that the "surge" of additional US troops into Iraq has been a resounding success. I am not so confident. Under the "surge" policy the United States military has trained and equipped with deadly weapons those Iraqi militia members against whom they were fighting just months ago. I fear by arming and equipping opposing militias we are just setting the stage for a more tragic and dangerous explosion of violence, possibly aimed at US troops in Iraq . There is no indication that the Iraqi government has made any political progress whatsoever.
