The real issue here is not drugs but rather the issues of privacy, due process, probable cause and the fourth amendment. We are dealing with a constitutional issue of the utmost importance. It raises the question of whether or not we understand the overriding principle of the fourth amendment.

It is said that if one has nothing to hide, why object to testing? Because, quite simply, we have something to keep: our freedom, our privacy and the fourth amendment. The only answer to solving problems like this is to encourage purely voluntary drug testing, whereby each individual and each Member of the House makes the information available to those who are worried about issues like this.

Private employers should already be free to require drug testing as a condition or term of employment. This legislation, however, unnecessarily brings the Federal Government into this process. The threat of liability law suits will dictate that drug testing will be prevalent in jobs where abstinence from drug use is most critical. However, setting up taxpayer-funded federal programs here are not only unnecessary but ill-advised. The newspapers are replete with examples of various lawsuits filed as a consequence of false positives resulting from both scientific and human errors. This legislation involves the Federal Government so far as to require drug testing be completed by only a few government-favored drug testers. This bill also requires those small businesses who participate to mandatorily test employees for drug and alcohol abuse. This proposition treads dangerously on grounds violative of the fourth amendment. While the bill of rights is a limitation upon actions by the Federal Government, it does not restrict the voluntary actions of private employers and their employees. The case becomes far less clear when the Federal Government involves itself in what should simply be a matter of private contract. In fact, government involvement may actually constitute a hindrance upon employers ability to adequately test those employees for whom they feel testing may be a necessary job component.

Most of the Federal programs are unconstitutional to begin with, so eliminating waste and fraud and promoting efficiency for a program that requires a violation of someone else’s rights should not be a high priority of the Congress. But the temptation is too great, even for those who question the wisdom of the government programs, and compromise of the Fourth Amendment becomes acceptable.

After thousands of complaints were registered at the Federal Reserve and the other agencies, Richard Small was quoted as saying that in essence, the complaints were coming from these strange people who are overly concerned about the Constitution and privacy. Legal justification for the program, Small explained, comes from a court case that states that our personal papers, when in the hands of a third party like a bank, do not qualify for protection under the Fourth Amendment.

He is accurate in quoting the court case, but that does not make it right. Courts do not have the authority to repeal a fundamental right as important as that guaranteed by the Fourth Amendment. HHS should ensure that the regulation complies with the letter and spirit of the fourth amendment by requiring that law enforcement officials obtain a valid search warrant before seizing private medical records. H.R. 3108 waters down the fourth amendment by expanding the federal governments ability to use wiretaps free of judicial oversight. The fourth amendment’s requirement of a search warrant and probable cause strikes a balance between effective law enforcement and civil liberties. Any attempt to water down the warrant requirement threatens innocent citizens with a loss of their liberty. This is particularly true of provisions which allow for nationwide issuance of search warrants, as these severely restrict judicial oversight of government wiretaps and searches.

9. There is a danger that personal privacy will be a thing of the past. Even before 9-11, there were attacks on the privacy of all Americans- for good reasons, or so it was argued. The attacks included plans for national ID cards, a national medical data bank, and “Know Your Customer” type banking regulations. The need for enforcement powers for the DEA and the IRS routinely prompted laws that violated the Fourth amendment. The current crisis has emboldened those who already were anxious to impose restrictions on the American people. With drug and tax laws, and now with anti-terrorist legislation sailing through Congress, true privacy enjoyed by a free people is fast becoming something that we will only read about in our textbooks. Reversing this trend will not be easy.

A lot of times I get support from the other side of the aisle when they see the prohibitions that our legislation places on the First Amendment. Likewise, I get a lot of support when I would like to reduce the prohibitions on the Fourth Amendment in the area of privacy. Unfortunately, since 9–11, we have moved in the wrong direction. We are making more prohibitions by law on our Bill of Rights.

Mr. PAUL. Mr. Speaker, I urge my colleagues to read “You are a Suspect” by William Safire in today’s New York Times. Mr. Safire, who has been one of the media’s most consistent defenders of personal privacy, details the Defense Department’s plan to establish a system of “Total Information Awareness.” According to Mr. Safire, once this system is implemented, no American will be able to use the internet to fill a prescription, subscribe to a magazine, buy a book, send or receive e-mail, or visit a web site free from the prying eyes of government bureaucrats. Furthermore, individual internet transactions will be recorded in “a virtual centralized grand database.” Implementation of this project would shred the Fourth Amendment’s requirement that the government establish probable cause and obtain a search warrant before snooping into the private affairs of its citizens. I hope my colleagues read Mr. Safire’s article and support efforts to prevent the implementation of this program, including repealing any legislation weakening privacy protections that Congress may inadvertently have passed in the rush to complete legislative business this year.

I would suggest that maybe the urgency is not quite as much as one thinks. I want to quote Michael Barone who was trying to justify a constitutional amendment that allows governors to appoint moc in a time of crisis. He said, “think of all the emergency legislation that Congress passed in the weeks and months after September 11 authorizing expanded police powers. None of this could have happened”. But now as we look back at those emergency conditions, a lot of questions are being asked about the PATRIOT Act and the attack on our fourth amendment and civil liberties. I suggest there could be a slower approach no harm will come of it. Mr. DREIER. Mr. Speaker, will the gentleman yield?

There are many reasons why government continues to grow. It would be naïve for anyone to expect otherwise. Since 9-11, protection of privacy, whether medical, personal or financial, has vanished. Free speech and the Fourth Amendment have been under constant attack. Higher welfare expenditures are endorsed by the leadership of both parties. Policing the world and nation-building issues are popular campaign targets, yet they are now standard operating procedures. There’s no sign that these programs will be slowed or reversed until either we are stopped by force overseas (which won’t be soon) or we go broke and can no longer afford these grandiose plans for a world empire (which will probably come sooner than later.)

Yes, we talked about numbers of dozens of examples of times when our government has used this and abused it. But that is only the beginning. It is the principle. If they had only done it once, if they had not done it, this should still be taken care of, because as time goes on, and if we adapt to this process, it will be used more and more, and that is throwing away a big and important chunk of our Constitution, the fourth amendment.

One of the arguments is that success has been proven that these easy-to-obtain search warrants have produced success in catching certain criminals, but that does not prove that we could not have done it legitimately by following the fourth amendment; so we do not know whether they would not have been caught or not. Another thing is; does sacrificing security and liberty ever justify more catching of so-called criminals? What if we had a total police state? What if we turned our whole country into a concentration camp? We could make sure there would be no crimes whatsoever.

The drafters of the Bill of Rights considered this essential protection against an overreaching government. For example, Section 215 of the PATRIOT Act, popularly known as the libraries provision, allows Foreign Intelligence Surveillance Courts, whose standards hardly meet the constitutional requirements of the Fourth Amendment, to issue warrants for individual records, including medical and library records. H.R. 3199 does reform this provision by clarifying that it can be used to acquire the records of an American citizen only during terrorist investigations. However, this marginal change fails to bring the section up to the constitutional standard of probable cause.

USA Today’s Editorial of March 1, “Patriot Act ‘compromise’ trades liberty for safety,” accurately describes how people concerned about individual liberty should react to S. 2271’s “reforms”: “Big Deal. By any standard of respect for the Bill of Rights, those provisions never should have been in the law in the first place. What is it about the Fourth Amendment (‘The right of the people to be secure . . . against unreasonable searches and seizures shall not be violated’) that Congress doesn’t get?”

S. 2271 Fails To Address The Constitutional Flaws In The PATRIOT Act

Among S. 2271’s flaws are provisions restricting recipients of a “gag” order regarding government seizure of private records from seeking judicial review of such orders for a year and requiring that recipients prove government officials acted in “bad faith,” a ridiculously high standard, simply to be able to communicate that the government has ordered them to turn over private records. The bill also requires that recipients of National Security Letters, which can be abused to sidestep the requirements of the Fourth Amendment, provide the FBI with the names of any attorneys from whom they have sought legal counsel from. S. 2271 would thus prohibit a National Security Letter recipient from even asking a lawyer for advice on complying with the letter without having to report it to the FBI. In fact, S. 2271 requires National Security Letter recipients to give the FBI the names of anyone they tell about the letter. This provision will likely have a chilling effect on a recipient of a National Security Letters ability to seek legal advice or other assistance in challenging or even complying with the National Security Letter.

Small, family farmers and ranchers will be forced to spend thousands of dollars, as well as comply with new paperwork and monitoring regulations, to implement and operate NAIS. These farmers and ranchers will be paying for a massive assault on their property and privacy rights as NAIS forces farmers and ranchers to provide detailed information about their private property to the government. In addition, the NAIS system empowers the Federal government to enter and seize property from farmers and ranchers without a warrant. Mr. Speaker, this is a blatant violation of the Fourth Amendment-protected right to be free of arbitrary searches and seizures.

Mr. PAUL. Mr. Speaker, Congress is once again rushing to abandon its constitutional duty to protect the constitution balance between the executive, legislative, and judicial branches of government by expanding the executive’s authority to conduct warrantless wiretaps without approval from either a regular federal court or the Foreign Intelligence Surveillance Act (FISA) court. Congress’s refusal to provide any effective checks on the warrantless wiretapping program is a blatant violation of the Fourth Amendment and is not necessary to protect the safety of the American people. In fact, this broad grant of power to conduct unchecked surveillance may undermine the government’s ability to identify threats to American security.

The Protect America Act sidelines the FISA Court system and places authority over foreign surveillance in the director of national intelligence and the attorney general with little if any oversight. While proponents of this legislation have argued that the monitoring of American citizens would still require a court-issued warrant, the bill only requires that subjects be “reasonably believed to be outside the United States.” Further, it does not provide for the Fourth Amendment protection of American citizens if they happen to be on the other end of the electronic communication where the subject of surveillance is a non-citizen overseas.

The main reason I oppose this latest version is that it still clearly violates the Fourth Amendment of the Constitution by allowing the federal government to engage in the bulk collection of American citizens’ communications without a search warrant. That US citizens can have their private communication intercepted by the government without a search warrant is anti-American, deeply disturbing, and completely unacceptable.

In addition to gutting the fourth amendment, this measure will deprive Americans who have had their rights violated by telecommunication companies involved in the Administration’s illegal wiretapping program the right to seek redress in the courts for the wrongs committed against them. Worse, this measure provides for retroactive immunity, whereby individuals or organizations that broke the law as it existed are granted immunity for prior illegal actions once the law has been changed. Ex post facto laws have long been considered anathema in free societies under rule of law. Our Founding Fathers recognized this, including in Article I section 9 of the Constitution that “No bill of attainder or ex post facto Law shall be passed.” How is this FISA bill not a variation of ex post facto? That alone should give pause to supporters of this measure.

Madam Speaker, giving the federal government the power to force Americans who wish to work in real estate to submit their fingerprints to a federal database opens the door to numerous abuses of privacy and civil liberties and establishes a dangerous precedent. Fingerprint databases and background checks have been no deterrent to espionage and fraud among governmental agencies, and will likewise fail to prevent fraud in the real estate market. I am amazed to see some members who are usually outspoken advocates of civil liberties and defenders of the Fourth Amendment support this new threat to privacy.

Madam Speaker, I rise in opposition to this resolution, which is yet another meaningless but provocative condemnation of China . It is this kind of jingoism that has led to such a low opinion of the United States abroad. Certainly I do not condone human rights abuses, wherever they may occur, but as Members of the US House of Representatives we have no authority over the Chinese government. It is our Constitutional responsibility to deal with abuses in our own country or those created abroad by our own foreign policies. Yet we are not debating a bill to close Guantanamo , where abuses have been documented. We are not debating a bill to withdraw from Iraq , where scores of innocents have been killed, injured, and abused due to our unprovoked attack on that country. We are not debating a bill to reverse the odious FISA bill passed recently which will result in extreme abuses of Americans by gutting the Fourth Amendment.

Some claim the federal government needs these powers to prevent criminal activity or to "protect" us from fraud committed against government health care agencies. Of course, monitoring the movements of every American to catch those few involved in illegal activity is a gross violation of the Fourth Amendment protection against search and seizure without warrants. The federal government does not have the right to treat Americans as criminals by spying on their relationships with doctors, employers and bankers. Likewise, since the federal government does not have the constitutional authority to operate health care agencies, the threat of fraud would evaporate with the end of these programs.

Under the existing Nixon-era Bank Secrecy Act, financial institutions already must report large transactions to the government. Under these new rules, not only would the banks have to collect the raw data on transactions like a low-level spy but will now be required to serve as the government's front-line investigators. Investigating who and what? Everyone, and everything financial. Forget the Fourth Amendment, forget the notion of innocent until proven guilty, and forget search warrants; these regulations assume everyone is as guilty as Al Capone.

The requirement that law enforcement officials obtain a warrant from a judge before searching private documents is one of the fundamental protections against abuse of the government’s power to seize an individual’s "papers."

Fortunately, the Supreme Court upheld the Fourth amendment in ruling against the hospital. The drug war has been used for too long as an excuse for unconstitutional actions by government. The Fourth and Fifth amendment prohibitions against unreasonable searches and compelled testimony routinely are ignored by legislators, law enforcement, prosecutors, judges, and especially federal agencies. As a result, all Americans have suffered the loss of liberties guaranteed to them in the Bill of Rights.

The Patriot Act waters down the Fourth amendment by expanding the federal government's ability to use wiretaps without judicial oversight. The requirement of a search warrant and probable cause strikes a balance between effective law enforcement and civil liberties. Any attempt to dilute the warrant requirement threatens innocent citizens with a loss of their liberty. This is particularly true of provisions that allow for issuance of nationwide search warrants that are not specific to any given location, nor subject to any local judicial oversight.

The Fourth Amendment to our Constitution requires the government to have a warrant when it wishes to look into the private affairs of individuals. If we are to remain a free society we must defend our rights against any governmental attempt to undermine or bypass the Constitution.
