We did a poor job in providing the security that all Americans should expect. This is our foremost responsibility. Some members have been quick to point out the shortcomings of the FBI, the CIA and the FAA and claim more money will rectify the situation. I’m not so sure. Bureaucracies by nature are inefficient. The FBI and CIA records come up short. The FBI loses computers and guns and is careless with records. The CIA rarely provides timely intelligence. The FAA’s idea of security against hijackers is asking all passengers who packed their bag.

If the responsibility had been left with the airlines to provide safety they may have had armed pilots or guards on the planes just as our industrial sites have. Privatizing the FAA, as other countries have, would also give airlines more leeway in providing security. My bill, HR 2896, should be passed immediately to clarify that the federal government will never place a prohibition on pilots being armed.

The problem was that the principle of private property was already undermined for the airlines by the partial federalization of security by FAA regulations. Airports are all owned by various government entities.

Sadly, the Congress went in the opposite direction in providing safety on commercial flights. Pilots are not carrying guns, and security has been socialized in spite of the fact that security procedures authorized by the FAA prior to 9–11 were not compromised. The problem did not come from failure to follow the FAA rules. The problem resulted from precisely following FAA rules. No wonder so many Americans were wisely assuming they better be ready to protect themselves when necessary.

One of the major shortcomings that led to the 9/11 tragedies was that the responsibility for protecting commercial airlines was left to the government, the FAA, the FBI, the CIA, and the INS. And they failed. A greater sense of responsibility for the owners to provide security is what was needed. Guns in the cockpit would have most likely prevented most of the deaths that occurred on that fateful day.

A clear understanding of private property and an owner’s responsibility to protect it has been seriously undermined. This was especially true for the airline industry. The benefit of gun ownership and second amendment protections were prohibited. The government was given the responsibility for airline safety through FAA rules and regulations, and it failed miserably.

How does this apply to the 9/11 tragedies? The airline owners accepted the rules of the inner city rather than those of rural America. They all assumed that the government was in charge of airline security—and unfortunately, by law, it was. Not only were the airlines complacent about security, but the FAA dictated all the rules relating to potential hijacking. Chemical plants or armored truck companies that carry money make the opposite assumption, and private guns do a reasonably good job in providing security. Evidently we think more of our money and chemical plants than we do our passengers on airplanes.

The complacency of the airlines is one thing, but the intrusiveness of the FAA is another. Two specific regulations proved to be disastrous for dealing with the thugs who, without even a single gun, took over four airliners and created the havoc of 9/11. Both the prohibition against guns in cockpits and precise instructions that crews not resist hijackers contributed immensely to the horrors of 9/11.

Mr. PAUL. Mr. Speaker, H.R. 5449 changes the rules under which the Federal Aviation Administration (FAA) negotiates with Federal employees unions, such as the National Air Traffic Controllers Association (NATCA), to make the FAA abide by the exact same process that other government agencies do when they negotiate with Federal employees unions. Contrary to the claims of its opponents, H.R. 5449 does not allow NATCA to indefinitely prolong negotiations. H.R. 5449 allows the FAA to act to end negotiations and bring their case before a Federal mediation board who has power to resolve the dispute. H.R. 5449 would prevent the FAA from unilaterally imposing a contract on the air traffic controllers. In contrast, the current system may provide the FAA with the opportunity to drag out negotiations, so it can ultimately declare an impasse and impose a contract. Thus, the changes made in H.R. 5449 seem reasonable.

Some people, including many House of Representatives members with whom I usually agree, are claiming that H.R. 5449 will cost American taxpayers billions of dollars. This claim is based on an assumption that the final result of the mediation process established by H.R. 5449 will be significantly more costly to the taxpayer then the contract the FAA will impose on the controllers if H.R. 5449 fails to pass. However, under H.R. 5449, the dispute will be resolved by a Federal mediation panel whose members are appointed by the president. I am skeptical that a presidentially appointed mediation board will give an exorbitant package to NATCA, especially since the difference between the FAA’s current proposal and the NATCA’s last offer is less than a billion dollars. It is true that a future mediation panel may be populated by people appointed by an administration more friendly to the air traffic controllers than the current administration, but it is also possible that a future Congress would use its leverage in the current process to force the FAA to accept contracts tilted in favor of the NATCA. We should not judge procedural issues based on uncertain predictions about results.

In conclusion, Mr. Speaker, H.R. 5449 reasonably changes the process under which the FAA negotiates with Federal employees unions. H.R. 5449 does not favor one party over another, and, contrary to the claims of its opponents, H.R. 5449 does not preordain the conclusion of the negotiations between the FAA and NATCA.

What Should Government Do for the Airlines?

However, the airlines do have a valid claim for compensation for lost profits from the government-imposed shutdown in the days following the attacks. First, remember that the government has made airline security almost purely a federal matter. The FAA and federal law enforcement agencies are charged with preventing terrorism, and the airlines in effect are not expected nor allowed to provide security. Second, the federal government utterly failed to provide that security on September 11th. Third, the federal government shut down the airlines for several days, limited flights for several more days, and undoubtedly made millions of Americans reluctant to fly because of its massive security lapse. So the airlines have been actively harmed by the government, and deserve compensation limited to their lost profits resulting from the recent disasters.

There are steps the government can take immediately to enhance airline security. It should undo regulations that have in effect disarmed pilots, and create a clear policy that permits airlines to establish their own rules regarding the arming of flight crews. Many commercial pilots once carried firearms, but federal rules now require that airlines go through a process of FAA-administered training classes that literally have never been conducted. It is ludicrous to leave pilots defenseless in the cockpit. A federal air-marshall program may be needed in the short run, but ultimately we should insist that pilots and flight crews be allowed to defend themselves and their passengers so that any future hijacking attempts can be thwarted.

Even after the huge failure by the FBI, FAA, CIA, and many other federal agencies to provide security and prevent the recent tragedy, some in Congress simply are calling for more money for these same failed agencies. Why should we increase funding for a system that is not working? Now is the time to change our approach and look for new solutions to make the flying public safe. We must reject the easy impulse to pour more federal dollars into the same failed policies.

We should recognize that pilots themselves overwhelmingly favor having the choice to carry a gun when they fly. In fact, some have refused to return to work until they are permitted to do so. The airline pilot's unions, including the large Air Line Pilot's Association, recently urged Congress to allow arming of pilots. Congress, the administration, and the FAA should not second-guess the actual pilots who ultimately stand in harm's way in the event of a hijacking attempt. Surely pilots know better than any of us how best to maintain security in the skies.

FAA regulations effectively prohibit flight crews from carrying weapons. Although airlines technically may send employees to FAA-conducted seminars to obtain permits, no such seminars have ever been held. I recently introduced legislation which establishes a clear federal rule that allows airlines to decide for themselves whether to arm pilots, without interference from the FAA or other federal agencies.

Remember, several federal agencies failed to prevent the September 11th attacks, including the FBI, CIA, and FAA. Now Congress wants to pour billions into the creation of a new federal workforce at airports. No doubt the federal union bosses are excited at the prospect of thousands of new members, but there is no reason to believe that an expansion of the Transportation department will produce better results. The pattern is always the same: government agencies fail to do their job, yet those same failed agencies are given more money and personnel when things go wrong.

TSA was created in the wake of the September 11, 2001 terrorist attacks. Although the National Guard, DOD, FBI, CIA, NSA, and FAA utterly failed to protect American citizens on that tragic day, federal legislators immediately proposed creating yet another government agency. But the commercial flying community did not want airport security federalized, and my office was inundated with messages from airline pilots opposing the creation of TSA. One pilot stated, “I don't want the same people who bring me the IRS and ATF to be in charge of airport security.” But Congress didn't listen to the men and women who spend their working lives flying, so it created another agency that costs billions of dollars, employs thousands of unionized federal workers, and produces poor results.
